1. The Subject Of The Order Is The Successive Delivery Of Road Aggregate For The Maintenance Of Municipal Roads In The Trzebownisko Commune. 2. The Scope Of The Order Includes: 1) Successful Delivery (Including Loading, Weighing, Transport And Unloading) Of Road Aggregate, Other Than Limestone And Other Than Dolomite, E.G. Sandstone, Basalt, Granite For Road Surface Renovations Managed By The Trzebownisko Commune. The Supplied Material Should Be Non-Weathering And Suitable For A Frost-Resistant Layer. 2) The Expected Amount Of Aggregate With A Fraction Of 31.5 - 63 Mm (Crushed Stone) Is 240 Tons And With A Fraction Of 4 - 31.5 Mm (Sorted Stone) Is 3,010 Tons, A Total Of 3,250 Tons. Water Absorption Not Exceeding 1% Guaranteeing Frost Resistance Of The Aggregate, Moreover, The Aggregate Must Be Approved For General Use In Road Construction (Declaration Of Performance) 4) The Stone Will Be Delivered To The Storage Site In Individual Villages In The Trzebownisko Commune (Roads Or Squares), Indicated By The Ordering Party, I.E. Jasionka, Łąka, Łukawiec, Stobierna, Tajęcina, Nowa Wieś, Trzebownisko, Wólka Podleśna, Zaczernie And Terliczka. 5) For Each Batch Of Delivered Stone (Crushed Stone/Crushed Stone), The Contractor Will Be Obliged To Attach: Each Weight Confirmation From The Manufacturer (From The Mine) Of The Delivered Aggregate, And, At The Request Of The Ordering Party, A Declaration Of Performance With The Above-Mentioned Standard. 6) If The Ordering Party Finds Any Deviations From The Ordered Product, He Will Refuse To Accept The Goods. The Ordering Party Reserves The Right To Appoint An Expert Who Will Check The Quality Of The Aggregate Or Test The Quality Of The Aggregate In The Laboratory. The Ordering Party Has The Right To Choose The Laboratory Where The Aggregate Will Be Tested. If The Aggregate Does Not Correspond To The Order, The Costs Of The Expert Opinion Will Be Covered By The Contractor. 7) The Ordering Party Reserves The Right To Consult The Mine/Aggregate Exploitation Plant Regarding The Quality Of The Purchased Aggregate. 8) Each Delivery Of Aggregate (Type, Quantity Of Stone And Place Of Delivery) Will Be Agreed In Detail Between The Ordering Party And The Contractor. 9) The Ordering Party Reserves The Right To Control Weigh The Delivered Aggregate (In The Trzebownisko Commune) And Control Its Quality. 10) If The Declared Weight Is Found To Be Inconsistent With The Control Weighing Or The Delivered Aggregate Is Of Inappropriate Quality. The Contractor Will Bear All Costs Of Such Checks And Tests. 11) If Any Of The Above-Mentioned Circumstances Are Found, The Ordering Party May Refuse To Pay The Remuneration, Charge The Contractor With The Costs Of Testing And Weight Control, Demand Replacement Of The Aggregate (At The Contractors Expense) With One That Meets The Requirements Within 3 Days From The Date On Which The Given Circumstance Occurred. 12) The Ordering Party Reserves The Right To Make Quantitative Shifts Between The
