5.1. The Subject Of The Order Are Construction Works Entitled: Construction Of A Warehouse Hall For The Needs Of Civil Protection And Civil Defense. Investment Plan Consisting In The Construction Of A Warehouse Building For The Needs Of Civil Protection And Civil Defense Together With The Reconstruction Of The Boiler Room And Construction Of An Exit From Plot 522/29 In Chojnice. The Investment Will Be Financed In The Form Of A Subsidy As Part Of The Implementation Of The Civil Protection And Civil Defense Program 2026/2027. The Subject Of The Order Is Specified In Detail In The Description Of The Subject Of The Order (Annex No. 7 To The Swz), The Draft Contractual Provisions (Annex No. 5 To The Swz) And The Design Documentation Constituting An Annex To The Swz.5.2. If In The Description Of The Subject Of The Order, Design Documentation, Technical Specifications For The Execution And Acceptance Of Works, Bills Of Quantities, Explanations For The Tender, The Ordering Party Indicates The Names Of Manufacturers Of Materials, Devices, Products, Etc., This Means That The Contractor May Adopt The Solutions Indicated By The Ordering Party Or Equivalent. However, The Contractor Must Demonstrate That The Materials, Devices, Etc. Used Are Equivalent. The Ordering Party Describes The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law Allows Solutions Equivalent To Those Described, And Such A Reference Is Accompanied By The Words Or Equivalent.5.3. All Terms And Names Of Materials Are Only Used To Determine The Quality Parameters Of The Materials Used. The Failure To Specify Specific Requirements By The Ordering Party Regarding The Standard Of Workmanship (Quality Of Materials, Equipment, Devices, Etc.) Means That The Contractor Will Fulfill Its Obligations When It Maintains An Average Standard Of Workmanship, After Its Acceptance By The Ordering Party. 5.4. The Ordering Party Will Consider That The Offer Is Equivalent If It Presents The Subject Of The Order With Functional And Qualitative Properties That Are The Same Or Better Than Those Specified In The Tor, But Marked With A Different Trademark, Patent Or Origin. What Is Important Is That An Equivalent Product Is A Product That Is Not Identical To The Reference Product, But Has Certain Features And Parameters That Are Important For The Ordering Party And Are Similar To The Reference Product.
