Detailed Quality Requirements, Performance Parameters Of The Subject Of The Order, As Well As Expected Quantities Are Included In The Price Form - Annex No. 3 To The Swz. Whenever The Ordering Party In The Content Of The Tor Indicates Specific Standards Or Processes Or Products That Could Lead To Restriction Of Competition, These Provisions Should Be Interpreted As Exemplary Requirements. The Ordering Party Allows Offering An Equivalent Subject Of The Contract Provided That The Offered Subject Meets The Minimum Requirements Specified By The Ordering Party. The Burden Of Proof In This Respect Rests With The Contractor. The Ordering Party Points Out That The Headquarters Of The Clinic, Which Is Also The Place Of Deliveries, Is Located In The Very Center And In The Paid Parking Zone Of The City Of Krakow, And The Ordering Party Is Not Able To Provide A Parking Space For Suppliers. The Contractor Must, On His Own, Find And Pay For A Parking Space Necessary For The Time Of Delivery Of The Order To The Place Of Delivery, I.E. To The Headquarters Of The Provincial Dental Clinic. The Offered Subject Of The Order Must Be Brand New, Complete, Of A High Standard Both In Terms Of Quality And Functionality, And Free From Material, Construction And Legal Defects. The Offered Subject Of The Order Must Be Admitted For Trading And Use In The Territory Of The Republic Of Poland In Accordance With Applicable Law. The Contractor Is Obliged To Absolutely Guarantee The Fulfillment Of The Quality Conditions Specified In The Production Permit Or Other Decisions Established By The Ministry Of Health, Based On Which The Goods Were Admitted To Trading In The Territory Of The Republic Of Poland, And To Comply With The Expiry Dates For The Delivered Goods. The Subject Of The Order Must Be Consistent With The Act Of April 7, 2022 On Medical Devices (Consolidated Text: Journal Of Laws Of 2024, Item 1620, As Amended) And The Implementing Acts To This Act (Applies To Medical Devices). The Ordering Party Reserves The Right To Ask The Contractors, During The Term Of The Contract, To Submit Safety Data Sheets For The Offered Goods And Documents Allowing The Offered Products To Be Traded And Used In Poland.
