Uninterruptible Power Supplies - The Subject Of The Order Includes The Delivery (Without Assembly And Commissioning) Of Components Of The Bess Electric Energy Storage System. The Subject Of The Order Includes The Delivery (Without Assembly And Commissioning) Of Components Of The Bess Electric Energy Storage System With Usable Power And Usable Capacity In Accordance With Annex No. 1A To The Opz (List Of Bess Projects). The Contractor Will Provide Complete, Brand New Devices, Prepared For Efficient Assembly And Commissioning By The Ordering Party Or A Separate Contractor, And Will Participate In The Commissioning Of The Delivered Bess System - In Accordance With The Opz. The Agreement Will Be Valid For A Period Of 36 Months From Its Conclusion. The Detailed Description Of The Subject Of The Order Consists Of The Following Documents: 1) Description Of The Subject Of The Order (Opz) 2) List Of Bess Projects Constituting Annex No. 1A To The Opz. The Ordering Party Plans To Deliver Bess Systems With A Total Target Capacity Of 840 Mwh Of Usable Capacity, In Various Power/Capacity Configurations, In Accordance With Annex No. 1A To The Opz. The Ordering Party Guarantees The Placing Of Orders And Purchase Of A Total Of At Least 600 Mwh Of Capacity. Use Within 24 Months From The Date Of Conclusion Of The Contract In Configurations Resulting From The Needs Of The Ordering Party And Annex No. 1A To The Opz. The Ordering Party Provides For The Possibility Of Exercising The Option Right In Accordance With Art. 441 Of The Pzp, Increasing The Scope Of The Order By 240 Mwh To The Planned Level Of 840 Mwh. The Ordering Party Reserves The Right To Exercise The Option Right (In Whole Or In Part) If The Basic Scope Is Exhausted During The Contract Period And At The Same Time The Purchase Of An Additional Quantity Of The Product Will Be In The Ordering Partys Interest And Results From Its Current Needs. The Exercise Of The Option Right Does Not Apply To The Contract Concluded Between Enea Ciepło Sp. Z O.O. As The Ordering Party And The Selected Contractor. The Ordering Party Allows The Possibility Of Granting The Contractor Advance Payments Towards The Execution Of The Subject Of The Order, In Accordance With Art. 442 Section 1 Of The Act On Public Procurement. The Total Value Of Advance Payments Will Not Exceed 100% Of The Gross Contractual Remuneration. The Detailed Method Of Granting Advance Payments Is Described In The Order Documentation.
