This Is A Composite Framework Agreement: - Partly An Ordinary Contract (1St Part - Firm Tranche And Optional Tranche) - Partly A Framework Agreement With A Purchase Order (2Nd Part) - 1St Part: Initial Supply And Maintenance Of An Irrevocable Right Of Use (Iru) For A Set Of Black Optical Fiber Links (Fon) For The Benefit Of The Bordeaux University Hospital (Firm Tranche) And The Ch Charles Perrens (Optional Tranche) The Contract Includes A Optional Tranche For The Establishment Part Ch Charles Perrens: - Package Initial Supply Of An Iru For A Set Of Dark Optical Fiber (Fon) Links Over A Distance Evaluated In The Technical Report Including Network Access Fees And Service Access Fees - Package Initial Maintenance Of An Iru For A Set Of Dark Optical Fiber (Fon) Links Over A Distance Evaluated In The Technical Report / Year - 2Nd Part: Additional Provision Of An Irrevocable Right Of Use (Iru) For A Set Of Dark Fiber Optic Links (Fon) For The Benefit Of The Bordeaux University Hospital And The Charles Perrens Hospital. The Framework Agreement Is Concluded For A Period Of 20 Years From Its Notification Date (The Date Of 01/01/2027 Is An Estimated Notification Date). The Maximum Amount Of The Purchase Order Portion For The Entire Duration Of The Framework Agreement Is 1,500,000 Euro(S) Excluding Tax. By Way Of Derogation From Article L.2125-1 1° Of The Public Procurement Code, The Duration Of The Framework Agreement Is 20 Years From Its Date Of Notification For The Following Reasons: - Economic Amortization Period: Significant Initial Investments Require A Long Contractual Duration To Be Economically Viable, Both For The Holder And The Contracting Authority. - Irrevocable Nature Of The Right Of Use: Liru Is, By Definition, An Irrevocable Right Of Use (Iru), Which Must Last Over Time To Allow Stable Operation Without Disruption Of The Network. An Iru On Optical Fibers Is A Permanent Contractual Right Granted To The Contracting Authority To Exclusive And Guaranteed Access To One Or More Pairs Of Optical Fibers, For A Long Period For The Interconnection Of All Sites. This Right Is Irrevocable, Which Means That The Contracting Authority Can Use These Fibers In A Stable And Continuous Manner, Without Risk Of Withdrawal, Thus Allowing Long-Term Investments In The Operation And Maintenance Of The Network. The Estimated Value Of 1,700,000 Euro(S) Excluding Tax Corresponds To The First Part Of This Contract
