(If Applicable), Technical Execution Project - P.T.E., Technical Assistance From The Designer During The Execution Of The Works, Technical Execution Project Updated On The Date Of Completion Of The Works - As Built, Technical Documentation For Obtaining The Water Management Authorization (If Applicable), Documentation For Approvals And Agreements And Execution Of Works For: Modernization Of Road Infrastructure Of County Road 205P Between The Localities Of Ivăncești - Făurei, Precistanu - Balta Raței Mircești And Dj 204D – Mândrești – Dn 23”, The Duration Of Execution Is 24 Months The Duration Of Providing Design Services Is 2 Months Technical Assistance Services From The Designer Will Be Provided Throughout The Execution Period Of The Works. The Number Of Days Until Which Clarifications Can Be Requested Before The Deadline For Submission Of Offers Is 20 Days. The Contracting Authority Will Respond Only Once To Requests For Clarifications On The 11Th Day Before The Deadline For Submission Of Offers. The Project Is Submitted For Approval Within The South East Regional Program 2021-2027, Specific Objective 3.2 Development And Growth Of Sustainable National, Regional And Local Mobility, Resilient To Climate Change, Intelligent And Intermodal, Including Improving Access To Ten-T And Cross-Border Mobility, Action 4.1 - Investments Intended To Rehabilitate And Modernize Road Infrastructure Of Regional Importance To Ensure Connectivity To The Ten-T Network, Call Prse/4.1/2/2025, Being In The Evaluation Stage. The Contracting Authority Specifies That It Will Conclude The Public Procurement Contract With The Bidder Declared The Winner, Subject To A Resolutory Condition, In The Sense That Failure To Obtain Funding Through The South East Regional Program 2021-2027, Within A Maximum Of 12 Months From The Date Of Signing The Public Procurement Contract And The Establishment Of The Gbe, Leads To The Legal Termination Of The Contract. In The Case Of The Fulfillment Of The Resolutive Condition (Lack Of Financing), The Contract Is Considered Terminated With Retroactive Effect, As If It Had Never Been Concluded, According To Art. 1401 Civil Code. The Parties Agree That, Until The Date Of Fulfillment Of The Condition Or The Expiry Of The Maximum Period Of 12 Months, The Contractor Shall Not Start The Activities That Would Generate Costs, The Contracting Authority Not Being Required To Pay Any Compensation In Case Of Termination Of The Contract. We Specify That, In Full Agreement With The Principle Of Good Faith, The Contracting Authority Submits All The Necessary Administrative Diligence To Obtain The Financing.
