Prior Information Notice For Medical Aids - Contract In Accordance With Section 127 Paragraph 1 Sgb V For The Provision Of Breast Prostheses From Product Group 37 To Those Insured By Aok Rheinland-Pfalz/Saarland. Aok Rheinland-Pfalz/Saarland Intends To Conclude A Contract In Accordance With Section 127 Paragraph 1 Sgb V On The Supply Of Insured Persons With Aids From Product Group 37 (Breast Prostheses). The Subject Of The Contract Is The Provision Of Additional Free Supplies To Insured Persons With Aids From Product Subgroup 37 Of The List Of Aids In Accordance With Section 139 Sgb V, Including All Related Services. The Requirements Of The Currently Applicable List Of Medical Aids In Accordance With Section 139 Sgb V Represent The Minimum Requirements For The Medical Aids To Be Provided. The Contract Does Not Contain A Right To Carry Out A Specific Number Of Supplies For Those With Statutory Health Insurance Or A Specific Delivery Quantity. Contractual Partners Can Only Become Service Providers Who Meet The Requirements For Sufficient, Appropriate And Functional Production, Delivery And Adaptation Of The Aids And Can Provide Proof In The Form Of A Certificate From A Suitable, Independent Body (Prequalification Body). With This Preliminary Information, A Contractual Intention Is Made Known In Accordance With Section 127 Paragraph 1 Sentence 6 Sgb V. The Proposed Contract Is Not A Public Contract Within The Meaning Of Section 103 Paragraph 1 Of The Act Against Restraints Of Competition (Gwb), As No Economic Operator Is Granted Exclusive Status. Part 4 Of The Gwb And The Procurement Regulations Do Not Apply. It Is Also Not A Call For Competition Within The Meaning Of Public Procurement Law.
