1. The Subject Of The Order Is The Design And Construction Of An Active Pedestrian Crossing On Pułaskiego Street In Suwałki In The So-Called Design And Build Formula. The Scope Of The Order Includes: 1) Development Of Design Documentation Including The Design Of An Active Pedestrian Crossing At Ul. Pułaskiego In Suwałki, On Plots No. 22792; And 22170/1, At The Intersection With Szczęsnowicza Street;2) Development Of A Temporary Traffic Organization Project;3) Development Of A Permanent Traffic Organization Project;4) Obtaining A Building Permit Or Reporting Construction Works Based On The Developed Design Documentation;5) Execution Of Construction Works Based On The Developed Design Documentation;6) Implementation Of Permanent Traffic Organization.2. A Detailed Description Of The Subject Of The Order Is Included In The Functional And Utility Program.3. Pursuant To Art. 101 Section 4 Of The Act, In The Place Where The Subject Of The Order Is Described Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows Solutions Equivalent To Those Described. Furthermore, All Such References Should Be Deemed To Be Accompanied By The Words Or Equivalent. Indication Of The Equivalence Of The Offered Solution In Accordance With Art. 101 Section 5 Of The Act And On The Principles Specified Therein Rests With The Contractor.4. Design Documentation Regarding The Description Of The Proposed Materials And Devices Should Be Prepared In Accordance With Art. 99 Of The Public Procurement Law. 5. Technical Documentation Should Take Into Account The Provisions Of Art. 100 Of The Public Procurement Law. I.E. In The Case Of Contracts Intended For Use By Natural Persons, Including Employees Of The Ordering Party, The Description Of The Subject Of The Contract Is Prepared, Taking Into Account The Requirements Regarding Accessibility For Disabled People And Design For All Users, Unless This Is Not Justified By The Nature Of The Subject Of The Contract. If The Requirements Referred To In Paragraph 1 Result From An Act Of European Union Law, The Subject Of The Contract, In Terms Of Requirements Regarding Accessibility For Disabled People And Design For All Users, Is Described By Reference To This Act.6. In The Case Of Description Using Standards, Equivalent Solutions Are Those That Ensure Compliance With The Minimum Requirements Specified In The Standard At A Level Not Worse Than That Described In The Relevant Standards. In The Case Of Standards Referred To In The Swz (Unless Specified In Detail), Current Standards Are Understood.
