The Scope Of The Public Procurement With The Specified Subject Includes The Supply Of Electrical Energy By Dpi For Customers Connected To The Low- And Medium-Voltage Power Distribution Network For The Objects Placed Under The Management Of The Supreme Judicial Council, Located On The Territory Of The Supplier Companies Of Last Resort, In Accordance With The Designated License Territories. According To Art. 39, Para. 1, Item 13 Of The Energy Law /Ze/ The Supply Of Electricity By A Supplier Of Last Resort /Dpi/ Is An Activity That Is Subject To Licensing. On The Basis Of Art. 43, Para. 2, Item 4 Of The Ze For A Single Territory, Only One License Is Issued For The Supply Of Electricity From A Supplier Of Last Resort For Customers Connected To The Electricity Distribution Network Of The Relevant Territory. According To Art. 21, Para. 1, Item 1 Of The Ze Licenses Are Issued By The Commission For Energy And Water Regulation /Kevr/. The Awarding Of The Public Contract Has The Nature Of A Procedure Under Art. 79, Para. 1, Item 3, Letter C Of The Zop, Insofar As Awarding The Contract To Other Persons, Other Than Those Licensed For The Corresponding License Territories, Would Lead To A Violation Of Exclusive Rights Acquired By Virtue Of A Law Or An Administrative Act. ​​​​​​​
