Agricultural, Forestry, Horticultural, Aquacultural And Apicultural Services – External Service Provider For Services In Accordance With The North Rhine-Westphalia Poisonous Animals Act. The Problem Of The Dangers Posed By Very Dangerous Poisonous Animals Kept In Private Households Was Counteracted By The Enactment Of A Formal State Law (North Rhine-Westphalia Poisonous Animal Act). According To Section 6 Para. 1 Gifttierg Nrw, The State Office For Consumer Protection And Nutrition Is Responsible For Enforcing The Gifttierg Nrw As A Special Regulatory Authority. The State Office Is Authorized To Issue Bans On Keeping Animals If The Ban On Keeping Animals Is Violated Or If The Conditions For Continuing To Keep A Population (§ 4 Gifttierg Nrw) Are No Longer Met. According To Section 5 Paragraph 1 Gifttierg Nrw, In The Event Of A Ban On Keeping Animals, The State Office Should Order That The Person Keeping Them Must Tolerate The Removal Of The Animal Or Animals By The State Office Or A Person Commissioned By The State Office. For The Tasks Resulting From § 5 Gifttierg Nrw (Species Identification, Professional Removal And Relocation Into Transport Containers, Professional Safe Transport As Well As The Species-Appropriate And Behaviorally Appropriate Accommodation Of Poisonous Animals Taken Away Due To Bans On Keeping Them) As Well As The Poisonous Animals That May Be Confiscated As Part Of Criminal Or Administrative Offense Proceedings Within The Meaning Of §§ 8 And 9, Lave Is Dependent On Cooperation With External Service Providers For Various Reasons. In A Few Exceptional Cases, Poisonous Animals From Private Keepers Can Also Be Handed Over To The State Office In Accordance With Section 4 Of The Gifttierg Nrw, Which Arise As Part Of An Inheritance If The Heir Or Legatee Wishes To Voluntarily Forego Keeping These Animals. The State Office Has Neither A Suitable Reception Facility Nor Appropriately Equipped Transport Vehicles, The Necessary Specialist And Specialist Knowledge For Keeping Them Or The Necessary Equipment And Containers In Connection With The Species Identification, Removal, Collection And Accommodation Of Poisonous Animals, So That The Commissioning Of External Service Providers Is Absolutely Necessary For The Enforcement Of The Nrw Poisonous Animals Act And Is Also Provided For By The Legislature In Accordance With The Gifttierg Nrw. Due To Species Protection And Animal Welfare Regulations (Reserve Of Permission In Accordance With Section 11 Of The Animal Welfare Act), The Animals Must Be Accommodated In Germany Until They Are Sold Or Passed On.
