1. The Subject Of The Order Is The Provision Of Sanitary Transport Services For The Municipal Hospital In Ruda Śląska Sp. Z O. O. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To The Swz/Agreement, In Annex No. 4 To The Swz/Annex No. 6 To The Agreement And In Annex 9 To Swz.2. Pursuant To Art. 95 Section 1 Of The Act, The Ordering Party Requires That Persons Performing Activities Directly Related To The Performance Of The Service (I.E. Drivers Authorized To Drive Vehicles That Will Be Used During The Performance Of The Service Under This Contract) Are Employed Under An Employment Contract.3. The Requirements Regarding The Method Of Documenting The Employment Of A Person Under An Employment Contract, The Ordering Partys Control Rights And Sanctions For Failure To Meet The Requirements Referred To In Point 2 Above, Have Been Specified In Detail In The Draft Provisions Of The Contract, Which Will Be Introduced Into The Content Of The Procurement Contract (Annex No. 9 To The Swz).4. Whenever Polish Standards Are Mentioned In The Procurement Documents, It Should Be Understood As Polish Standards Transposing European Standards Or Standards Of Other Member States Of The European Economic Area Or Other Standards Or Documents Referred To In Art. 101 Section 1 Point 2 Of The Act. Where The Description Of The Subject Of The Contract Includes Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And 3 Of The Public Procurement Law, The Ordering Party, In Accordance With Art. 101 Section 4 Of The Public Procurement Act Allows The Submission Of Offers Containing Solutions Equivalent To Those Described, In Terms Of Their Quality, Intended Purpose And Functions And Utility Values. The Contractor May Refer In The Offer To The Use Of Equivalent Solutions Described In The Swz, Submitting A List Of Equivalent Solutions. In Such A Case, The Contractor Is Obliged To Demonstrate That The Solutions He Offers Meet The Requirements Specified By The Ordering Party (Equivalence Criteria) And Will Be Marked As Equivalent. In The Scope Of The Solution Proposed As Equivalent - The Contractor Should Prove In The Offer, In Particular By Means Of Evidence Referred To In Art. 104 - 107 Of The Act, That The Proposed Solutions Meet Those Required By The Ordering Party. At The Stage Of Conducting The Procedure, The Ordering Party Requires The Contractor To Submit An Inquiry Regarding The Acceptance Of An Equivalent Solution. The Contractor Who Uses Equivalent Solutions Will Be Obliged To Demonstrate During The Execution Of The Order, At Each Request Of The Ordering Party, That The Solutions He Uses Equally Meet The Requirements Specified By The Ordering Party In The Description Of The Subject Of The Order.
