1. The Subject Of The Order Is The Maintenance And Conservation Of Greenery In The City Of Lubawa. The Subject Of The Order Is Described In Detail In Annex 1 To The Swz Tender Form. Moreover: 1) Any Work Performed Unjustifiably Or Without Prior Agreement With The Ordering Party Will Not Be Subject To Settlement. 2) The List Of Green Areas, Shrubs And Roses Covering The Subject Of The Order Is Attached As Annex No. 10 To The Swz. The Ordering Party Reserves The Right To Commission Works Also Belonging To The Lubawa Municipality.3) The Contractor Is Obliged To Perform The Subject Of The Order In Accordance With Applicable Regulations, And In Particular In Compliance With The Requirements Of The Act Of December 14, 2012 On Waste And The Act Of September 13, 1996 On Maintaining Cleanliness And Order In Municipalities.4) Under The Contract, The Contractor Will Be Obliged To Maintain Cleanliness And Order And Provide Ongoing Servicing Of Playgrounds. If Damage To The Play Equipment Is Found, The Contractor Will Secure The Damaged Device And Immediately Notify The Ordering Party In Writing Of The Damage Found. 5) Emergency Response Time For Removing Windfalls/Breakouts - Up To 1 Hour From The Notification Of The Action By The Ordering Party. Emergency Removal Is Understood As The Physical Initiation Of Action To Eliminate Windbreaks/Breakouts That Threaten The Safety Of Residents.2. The Contractor Is Obliged To Properly Manage Waste Generated As A Result Of The Work, I.E. To Transfer The Waste To Appropriate Disposal And Recovery Sites, In Accordance With Applicable Regulations, At Its Own Expense. The Currently Applicable Regulations Do Not Provide For Regionalization In The Field Of Municipal Waste Management. Entrepreneurs Who Collect Municipal Waste And Manage It May Transfer This Waste To Any Installation In The Country. However, It Should Be Noted That There Is A Principle Of Proximity, Which Requires Waste Processing In The Nearest Installation (Article 20(2) Of The Waste Act). The Lubawa Municipality Belongs To The Ecological Association Of Municipalities Działdowszczyzna Based In Działdowo. The Association Has A Municipal Installation In Działdowo, Which Includes: A Sorting Plant, A Composting Plant And Waste Landfills In Zakrzew And Ciechanówek. The Contractor Is Obliged To Properly Manage Waste Generated As A Result Of The Works, I.E. To Transfer The Waste To The Installations Managed By The Ecological Association Of Municipalities Działdowszczyzna. All Collected Waste Should Be Transferred To The Municipal Installation. The Contractor Will Be Obliged To Submit, Together With The Monthly Settlement, Information On The Amount Of Waste Generated And Collected As Part Of The Execution Of The Order. Such Information Must Be Confirmed Or Issued By The Municipal Installation To Which The Waste Was Transferred.
