The Subject Of The Order Is The Construction, Reconstruction And Modernization Of Municipal Roads In The City And Commune Of Mordy In The Design And Build System, Including The Roads Indicated In Point 1 - General Description Of The Subject Of The Order Of Part I - Descriptive Part - Of The Functional And Utility Program Constituting Annex No. 1 To Swz.2. The Order Includes: 1) Preparation Of A Construction Design/Technical Documentation And Obtaining, On Behalf Of And For The Benefit Of The Ordering Party, The Following Provisions: Decisions, Opinions, Consents, Notifications, Arrangements And Permits; Including Obtaining Derogations From Technical And Construction Regulations - If Necessary;2) Carrying Out Construction Works On The Basis Of Prepared And Agreed Documentation;3) Obtaining An Occupancy Permit - If Required.3. The Order Must Be Performed In Accordance With The Attached Functional And Utility Program Constituting Appendix No. 1 To Swz.4. The Names, Brands Or Origin Of Products Or Materials Mentioned In Any Part Of The Description Of The Subject Of The Order Are Not Obligatory For The Contractors. Contractors Have The Right To Offer Other Equivalent Products Or Materials Provided That They Ensure Technical, Technological, Operational And Quality Parameters That At Least Meet Or Exceed The Parameters Of The Products Or Materials Required In The Swz Or Annexes To The Swz. The Obligation To Prove The Equivalence Of The Products, Materials, Etc. Used Will Rest With The Contractor. Pursuant To The Provisions Of Art. 101 Section 5 Of The Public Procurement Law, The Contractor Invoking The Use Of Equivalent Solutions Is Obliged To Demonstrate That The Solutions He Offers Meet The Requirements Specified By The Ordering Party. In Such A Situation, The Ordering Party Requires The Submission Of Appropriate Documents With The Offer, Confirming That These Materials Or Devices Meet The Requirements.5. During The Performance Of The Works, The Contractor Is Obliged To Have A Construction Manager At His Disposal Who Has Construction Qualifications To Manage Construction Works In The Road Specialty Without Restrictions And Has A Minimum Of 2 Years Of Professional Experience.6. The Minimum Warranty And Warranty Period For Defects Is 36 Months, Counting From The Date Of Signing The Final Work Acceptance Protocol. The Contractor Will Provide Mandatory Warranty Inspections During The Warranty And Warranty For Defects Period Offered In The Offer.
