Sports Facilities Operation Services – Public Service Delegation Agreement For The Operation Of The “Les Bains D’Orée” Aquatic Center. By Deliberation Dated December 16, 2025, The Community Council Of The Community Of Communes Of Lorée De Bercé-Belinois (Hereinafter Referred To As The Ccobb), After Having Taken Note Of The Reasoned Opinion Of The Territorial Social Committee, Approved The Principle Of The Delegation Of The Community Swimming Pool Les Bains Dorée, For A Period Of 4 Years And 8 Months From May 9, 2027. Management Of The Services Is Ensured By The Delegate At Its Own Risk, Which Implies Real Exposure To The Vagaries Of The Market, So That Any Potential Loss Borne By The Delegate Must Not Be Purely Theoretical Or Negligible. The Delegate Assumes The Operating Risk In Accordance With The Legislation, The Regulations In Force, The Rules Of The Art And The Clauses Of The Public Service Delegation Contract With The Permanent Concern To Ensure The Continuity Of The Public Service, The Conservation Of The Ccobbs Heritage, To Respect The Rights Of Third Parties And The Quality Of The Environment. The Public Service Delegation Contract Will Be Concluded For A Period Of Four (4) Years And Eight (8) Months. The Effective Date Is May 9, 2027. The Orée Community Of Bercé-Belinois Commissioned Its New Aquatic Center In 2011, Which Is Now Called “Les Bains D’Orée”. The Nautical Center Includes In Particular: - A Total Of Useful Covered Areas Of 1,500 M² - A Total Of Water Areas Of 379.95 M² - A Total Of Green Space Areas Of 4,000 M² The Future Contract Will Relate To These Spaces. The Delegate Is Responsible, As Such, For Ensuring The Maintenance And Cleaning Of The Entire Perimeter Of The Service, Except The Asphalted Parts Of The Car Park. The Delegatee Is Remunerated By Revenues Derived From The Operation Of The Public Service Under The Conditions Provided For In The Contract And By An Annual Fixed Financial Contribution Paid By The Delegating Authority. It Pays Annually To The Delegating Authority A Fee For Occupying The Public Domain And, Where Applicable, An Incentive Under The Conditions Provided For In The Contract. The Characteristics Of The Services To Be Provided By The Delegatee Are Detailed In The Draft Contract.
