1. The Subject Of The Order Is The Construction Of A Municipal Road - Ul. Mała In Dobrzyca.2. The Scope Of Works Includes The Implementation Of Road Works In Accordance With The Design Documentation And Applicable Regulations And Technical Standards, Excluding The Construction Of Individual Exits.3. The Task Also Involves Replacing The Telecommunication Well, After Obtaining All Required Administrative Decisions, Arrangements And Consents Of The Infrastructure Owner. 4. Names And Codes Specified In The Common Procurement Vocabulary: Construction Works - 45000000-75. A Detailed Description Of The Subject Of The Order And The Scope Of The Order Was Described Using The Design Documentation, Excluding The Bill Of Quantities, And Using The Technical Specification For The Execution And Acceptance Of Construction Works, Constituting Annex No. 1 To The Specification Of The Terms Of The Order, Hereinafter Referred To As The Swz. Other Conditions Regarding The Implementation Of The Contract Are Specified In Annex No. 3 To The Swz (Drafted Provisions Of The Public Procurement Contract).6. The Reason For Not Dividing The Order Is The Nature Of The Subject Of The Order And The Technology Of Its Implementation. Road Construction Constitutes One Inseparable Functional And Technical Whole, Where Individual Stages (Substructure, Surface, Drainage) Are Closely Interconnected, Interpenetrate And Must Be Performed Completely In A Specific Technological Regime. When Dividing The Contract Into Parts, There Is A Risk Of Not Selecting A Contractor. Due To The Consistency Of The Construction, Failure To Select A Contractor For Even One Part Would Result In The Inability To Complete The Entire Subject Of The Contract. It Is Also Important That The Execution Of The Subject Of The Contract By One Contractor, At Least Due To The Fixed Costs Of Maintaining One Construction Site, Significant Amounts Of Ordered Construction Materials, And Therefore Lower Prices, Results In A Lower Cost Of Execution Of The Subject Of The Contract. Moreover, The Need To Coordinate The Activities Of Different Contractors Carrying Out Individual Parts Of The Contract Could Seriously Jeopardize The Proper Performance Of The Contract. Dividing The Subject Of The Contract Into Many Parts Also Carries A Significant Risk Of Difficulties And Obstacles In Determining The Contractor Responsible For The Proper Performance Of The Subject Of The Contract, Including Under The Warranty For Defects Or Liability Under Art. 471 Of The Act Of 23 April 1964, Civil Code. The Performance Of Each Scope Of Construction Works Affects The Next Scope Resulting From The Technology Of Construction Works. If The Subject Of The Order Is Performed By One Contractor, Responsibility For The Entire Construction Process, In Its Implementation Aspect, Is Unquestionably Borne By One Contractor. Failure To Divide The Contract Into Lots, Due To Its Small Scope And Size, Will Not Hamper Competition.
