Reasons For Not Dividing The Order Into Lots: The Ordering Party Does Not Plan To Divide The Order Into Parts, Because Its Size Does Not Constitute An Access Barrier To The Order For Smes And Dividing The Order Into Parts Is Impossible For Technological Reasons. Equivalent Solutions: 1) Equivalence - A Solution With The Same Purpose, Technical, Qualitative And Functional Features Corresponding To The Technical, Qualitative And Functional Features Indicated In The Description Of The Subject Of The Order, Or Better, Marked With A Different Trademark, Patent Or Origin; 2) The Ordering Party Allows The Offer Of Solutions Equivalent To Those Indicated In The Description Of The Subject Of The Order (Appendix No. 4 To The Tor) Provided That They Guarantee The Implementation Of Deliveries And Ensure Obtaining Technical Parameters Not Worse Than Those Indicated In The Description Of The Subject Of The Order (Annex No. 4 To The Swz) And Will Be Consistent In Terms Of: A) Functional Nature (Identity Of Function), B) Material Characteristics (Type And Quality Of Materials), C) Technical Parameters (Strength, Durability, Technical Data, Structures, Etc.), D) Safety Parameters Of Use, 3) An Equivalent Solution Must Allow The Achievement Of The Goal Assumed By The Ordering Party Through Performance And Functional Parameters Affecting The Effectiveness Of Operation, The Same Or Better Than Indicated Minimum Requirements;4) The Use Of The Names Of Solutions, Materials And Devices In The Description Of The Subject Of The Order (Appendix No. 4 To The Swz) Serves To Establish A Minimum Standard Of Workmanship And To Determine The Properties And Technical Requirements For The Adopted Solutions;5) The Lack Of The Term Minimum Means A Requirement At The Minimum Level, And The Contractor May Offer A Solution With Better Parameters;6) In Order To Maintain The Principles Of Technological Neutrality And Competitiveness, Solutions Equivalent To Those Specified Are Allowed, And Such An Equivalent Solution Is Considered A Solution That In Terms Of Technology, Performance And Functionality Does Not Differ From Or Is Better Than The Functional And Performance Technologies Specified In The Specified Solution;7) In Situations When The Ordering Party Describes The Subject Of The Contract By Referring To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act On Public Procurement, Allows Solutions Equivalent To Those Described.
