1. The Subject Of The Order Is The Supply Of Walnut-Type Hard Coal In An Amount Of 75 Mg, Including Transport.2. Required Quality Parameters Of Walnut Hard Coal: Parameter Unit Values Ash Content Up To 11.00% Total Sulfur Content Up To 1.40% Calorific Value Above 23.00 Mj/Kg Total Moisture Content Up To 15.00%3. The Deviation Of The Values Of Quality Parameters Is Allowed, Which Cannot Be Greater Than:• 3% Of The Value For The Ash Content;• 0.3% Of The Value For The Total Sulfur Content;• 1 Mj/Kg For The Calorific Value;• 3% Of The Value For The Total Moisture Content;• 5% Of The Value For The Undergrain Content;• 2% Of The Value For The Overgrain Content;• 2% Of The Value For The Volatile Matter Content.4. Deliveries Will Be Made Successively During The Term Of The Contract On Business Days From 7:00 A.M. To 2:30 P.M. By Road Transport, With Unloading At The Storage Yard Of The Ordering Partys District Boiler House At Ul. Democracy 5 In Ostróda.5. The Contractor Is Obliged To Present Laboratory Tests On The Basis Of Which A Solid Fuel Quality Certificate Will Be Issued.6. The Contractor Is Obliged To Issue A Solid Fuel Quality Certificate And Provide A Copy Of This Certificate Certified As A True Copy Of The Original To The Ordering Party.7. The Contractor Is Obliged To Provide A Statement On The Origin Of The Coal.8. Note - The Ordering Party Reserves The Right To Order A Smaller Or Larger Amount Of Fuel Than The Estimated Amount Indicated In Section 1 Of Chapter Iv, By A Maximum Of 40% Of The Quantity. The Final Amount Of Coal Ordered And Delivered Will Result From The Actual Needs Of The Ordering Party During The Term Of The Contract. The Contractor Accepts The Above Reservations And Agrees To Them. For This Reason, The Contractor Will Not Be Entitled To Any Monetary Claims Against The Ordering Party. The Ordering Party Informs That The Option Law Applies To The Delivery Of Coal, Which Means That The Values Given Are Estimates And Maximum Values That Should Be Used To Calculate The Offer Price.9. Loading, Transport And Unloading Of Coal Performed At The Contractors Expense And Risk.10. Subject Matter Of The Contract According To The Common Procurement Vocabulary (Cpv):• 09111210-5 – Hard Coal11. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Contract Template Constituting Annex No. 2 To Swz.12. The Ordering Party Reserves The Right To Reject Deliveries Of Walnut Hard Coal That Do Not Meet The Required Contractual Parameters. The Contractor Will Immediately Remove The Questioned Deliveries At Its Own Expense In The Event Of Delivery Of Walnut Hard Coal That Does Not Comply With The Contractual Parameters And Will Immediately Deliver Coal With The Required Parameters. In Case Of Doubts As To The Quality Of The Supplied Coal, The Ordering Party Is Obliged To Report This To The Contractor Within 1 Business Day And Will Provide The Results Of Laboratory Tests Within A Period Not Exceeding 7 Bus
