5.1. The Subject Of The Order Are Construction Works Entitled: Profiling And Compaction Of Dirt Roads In The Chojnice Poviat. 5.2. The Subject Of The Order Was Specified In Detail In The Description Of The Subject Of The Order, Technical Specifications, Bid Cost Estimate And Draft Contractual Provisions Constituting Annexes To The Swz.5.3. If In The Description Of The Subject Of The Order, Technical Specifications For The Execution And Acceptance Of Works, And Explanations For The Tender, The Ordering Party Indicates The Names Of Manufacturers Of Materials, Devices, Products, Etc., This Means That The Contractor May Adopt The Solutions Indicated By The Ordering Party Or Equivalent. The Ordering Party Describes The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law Allows Solutions Equivalent To Those Described, And Such A Reference Is Accompanied By The Words Or Equivalent.5.4. All Terms And Names Of Materials Are Only Used To Determine The Quality Parameters Of The Materials Used. The Failure To Specify Specific Requirements By The Ordering Party Regarding The Standard Of Workmanship (Quality Of Materials, Equipment, Devices, Etc.) Means That The Contractor Will Fulfill Its Obligations When It Maintains An Average Standard Of Workmanship, After Its Acceptance By The Ordering Party. 5.5. The Ordering Party Will Consider That The Offer Is Equivalent If It Presents The Subject Of The Order With Functional And Qualitative Properties That Are The Same Or Better Than Those Specified In The Tor, But Marked With A Different Trademark, Patent Or Origin. What Is Important Is That An Equivalent Product Is A Product That Is Not Identical To The Reference Product, But Has Certain Features And Parameters That Are Important For The Ordering Party And Are Similar To The Reference Product.
