Repair And Maintenance Services Of Rolling Stock - Performing The Fifth Maintenance Level (P5) Inspection Service Of Five 32Wea Type Vehicles Along With Additional Works. The Subject Of The Order Is The Provision Of Maintenance Level Five (P5) Maintenance For Five Electric Multiple Units Type 32Wea With Numbers 32Wea – 001 (En77-001 Series), 32Wea – 002 (En77-002 Series), 32Wea – 003 (En77-003 Series), 32Wea – 004 (Series En77-004), 32Wea - 005 (En77-005 Series) According To The Documentation Of The Maintenance System For 32Wea Electric Multiple Units And The Description Of The Subject Of The Order Approved By The Ordering Party. The Scope And Method Of Performing All The Works Referred To Above Are Included In Or Result From The Dsu, As Well As From The Technical And Operational Documentation. As Part Of The Basic Works, The Contractor Will Perform All Works And Services Referred To In Point 6 Of The Opz. The Subject Of The Order May Also Be The Performance Of Additional Works Related To P5 Level Technical Maintenance Of Individual Or All Vehicles, Going Beyond The Scope Of Work Provided For In The Dsu, Referred To In Point 7 Of The Opz. The Work Referred To In This Section May Be Ordered To Be Performed As Part Of The Ordering Partys Exercise Of The Option Right Indicated In § 10 Of The Draft Provisions Of The Agreement. A Detailed Description Of The Basic Work And Additional Optional Work Is Included In The Opz. The Contractor Will Perform The Works In Accordance With The Actual Condition Of The Vehicles On The Date They Were Handed Over To The Contractor By The Ordering Party. The Subject Of The Order Also Includes Providing The Ordering Party With All New Or Modernized Software Installed During Or In Connection With The Implementation Of P5, Together With All Administrative Authentications (For Operating Systems, Databases, Firmware, Etc.) In Order To Ensure The Ordering Partys Ability To Independently Repair The Vehicles And Perform P1-P5 Inspections, Including The Use Of The Vehicles And Software In Accordance With Their Intended Purpose, In Particular The Operation, Servicing And Modification Of The Vehicles. By The Software Referred To In The Preceding Sentence, The Parties Understand All Software That Will Be Installed On A Given Vehicle As Part Of P5 In Terms Of Its Systems, As Well As Software Installed (Embedded) In Individual Elements Or Components Or Systems In A Given Vehicle, If It Is Subject To Changes. The Subject Of The Order Also Includes The Transfer Of Intellectual Property Rights To The Ordering Party And/Or The Granting Of A License For The Software In Accordance With The Ppu. In Order To Avoid Interpretation Doubts, The Parties Indicate That The Obligation To Grant A License/Conclude A Software License Agreement Excludes Software That Has Been Previously Used On The Vehicles By The Ordering Party And Which Will Not Be Changed By The Contractor As Part Of The Subject Of The Order, As Well As Other Software, Provided That It Is Generally Available For Download And Use Without The Need To Obtain An Additional License (E.G. Linux, Android, Etc.). All Licenses Received By The Ordering Party Will Be Granted On The Terms Set Out In § 20 Of The Ppu. The Ordering Party Requires The Transfer Of
