A Detailed Description Of The Subject Of The Order Is Included In Annex No. 2 To The Swz - Price Form. 4.3. The Contractor Will Indicate In The Price Form (Appendix No. 2 To The Swz) The Name Of The Manufacturer/Importer And The Manufacturers Code For Each Item.4.4. An Attachment Constituting An Integral Part Of The Future Contract Will Be The Unit Order Price Form Indicating The Items And Unit Prices. 4.5. The Contractor Will Be Obliged To Deliver The Goods In Batches, The Quantity And Scope Of Which Will Depend On The Actual Needs Of The Ordering Party. The Quantities Of Individual Items Given In Annex No. 2 To The Swz Are Estimated Quantities Used To Calculate The Offer Price And May Change During The Implementation Of The Contract Concluded As A Result Of These Proceedings. However, The Total Value Of Individual Deliveries May Not Exceed The Maximum Value Of This Contract. The Final Total Value Of The Contract Resulting From The Summation Of Gross Prices Of Partial Deliveries Made On The Basis Of The Ordering Partys Orders During The Term Of The Contract May Therefore Be Lower Than Its Maximum Gross Value Indicated In The Contract (But Not Lower Than 70% Of The Maximum Gross Value Of The Contract), And In Such A Case The Contractor Will Not Be Entitled To A Claim For Payment Of The Difference Between The Final Value Of The Contract Determined As Indicated Above And Its Maximum Value. 4.6. Option Right: The Ordering Party Indicates That Regarding The Implementation Of The Subject Of The Contract Covered By These Proceedings, It Provides For The Option Right Referred To In Art. 31 Section 2 And 441 Of The Public Procurement Law. The Right Of Option For This Order Is That The Ordering Party Is Obliged To Purchase Only Part Of The Supplies Covered By This Order (Basic Order), While Regarding The Remaining Scope It May Purchase These Supplies, But Is Not Obliged To Do So (Optional Order): 1) The Ordering Party Is Obliged To Purchase The Subject Of The Order, With A Gross Value Not Lower Than 70% Of The Maximum Gross Value Of The Contractors Remuneration (The Maximum Gross Value Of The Contract Resulting From The Contractors Offer) Specified In § 4 Section 2 Contracts - The So-Called Basic Order; The Quantity Of Individual Items Provided For By The Ordering Party In The Procedure Documents, I.E. In The Price Form, Constituting Only An Indicative Amount (Necessary To Determine The Offer Price), May Change During The Implementation Of This Contract (Decrease In The Scope Of A Given Item To Increase The Quantity In The Scope Of Other Item(S), Which Does Not Constitute An Amendment To This Contract, And Will Ultimately Result From The Needs Of The Ordering Party Developing During The Term Of This Contract, Depending On The Statutory Activities, Projects, Works Or Research Carried Out By The Ordering Party, From The Information Sent By The Ordering Party Of Individual Orders, Alternatively Balancing The Gross Value In The Amount Of The Contractors Maxim
