1. The Subject Of The Order Is The Implementation Of The Task Entitled: Reconstruction Of The Milenium Swimming Pool Facility With Accompanying Infrastructure. A Detailed Description Of The Subject Of The Order Is Specified In Annex No. 7 To The Swz And In The Design Documentation Constituting Annex No. 8 To The Swz.2. The Ordering Party Does Not Allow The Submission Of Partial Offers. The Ordering Party Does Not Divide The Order Into Parts For The Following Reasons: The Contractor May Submit Only One Offer Covering The Entire Subject Of The Order. The Contract Was Not Divided Into Parts Due To The Specific Nature Of The Contract, Which Justifies Awarding The Contract To One Contractor. The Material Scope Of The Order Constitutes A Functionally And Technologically Inseparable Whole, The Proper Execution Of Which Requires Close Coordination Of All Industries At Every Stage Of The Investment Implementation. Dividing The Order Into Parts Would Be Irrational And Would Significantly Increase The Costs Of Order Execution, In Particular Through The Need To Duplicate Indirect Costs, Organizational Costs And Security For Proper Performance Of Contracts, As Well As Through An Increase In The Costs Of Supervision, Coordination And Contract Management. Thus, The Division Of The Contract Would Be Contrary To The Principle Of Efficiency In Spending Public Funds. Failure To Divide The Contract Into Parts Does Not Avoid The Application Of The Provisions Of The Public Procurement Law. And Does Not Hinder Competition. Separate Orders Would Cause Difficulties In Coordinating The Activities Of Various Contractors And Possible Subcontractors Implementing Individual Parts Of The Order.6. Whenever The Content Of The Swz, Including Its Annexes, Uses Trademarks, Patents Or Origins, Sources Or Specific Processes, As Well As Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows A Solution Equivalent To The One Described. A Product Equivalent To The Specified Subject Of The Order Is Understood As A Product With The Parameters And Minimum Requirements Specified (Listed) And Specified In Detail In The Description Of The Subject Of The Order Included In The Annex To The Swz. The Ordering Party Allows The Submission Of Equivalent Offers, And All Goods Specified In The Documentation, From Specific Manufacturers, Specify The Minimum Quality Parameters And Functional Features That The Goods Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only A Quality Standard Of The Subject Of The Order. By Specifying The Minimum Requirements For Quality Parameters, The Ordering Party Understands The Requirements Of The Goods Contained In Publicly Available Sources, Catalogs And Manufacturers Websites.
