The Subject Of The Tender Is The Selection Of The Contractor Who Will Deliver To The Ordering Party The District Hospital. Dr. Tytus Chałubiński In Zakopane, Two Brand New Echocardiographs, According To The List Of Minimum Technical, Quality, Operational And Functional Parameters Specified In Point 4.3 Of The Swz In Question, Along With Assembly And Commissioning At The Ordering Partys Headquarters, Ul. Kamieniec 10, 34-500 Zakopane. 2. The Ordering Party Stipulates That The Delivered Subject Of The Order Must Have The Required Permits Under Current Law, E.G. Permits, Certificates, Attestations And Markings Provided For In The Provisions Of The Act On Medical Devices, Proving The Required Authorization For Use And Marketing In Poland In Accordance With The Regulation Of The Minister Of Health On Essential Requirements And Procedures For Assessing The Conformity Of Medical Devices. 3. The Ordering Party Stipulates That The Subject Of This Order Must Be Delivered, Installed And Put Into Operation At The District Hospital. Dr. Tytus Chałubiński In Zakopane, Ul. Kamieniec 10 By The Contractor. 4. The Ordering Party Does Not Allow The Purchase Of Used Equipment. 5. The Subject Of The Order Must Be Marked By The Manufacturer In Such A Way That It Is Possible To Identify Both The Product And The Manufacturer. 6. The Contractor Who Wins This Procedure And Delivers The Devices Referred To Above Is Obliged To Conduct Training In Polish For At Least 2 Of The Ordering Partys Employees Regarding The Proper Operation And Operation Of The Delivered Device At The Ordering Partys Premises Upon Installation And Commissioning. Moreover, In The Case Of Delivery Of Equipment Powered By Electricity, The Contractor Is Obliged To Conduct Training In Energy Efficiency Optimization For At Least 2 Employees Of The Ordering Party, Which Includes Elements Related To The Regulation And Tuning Of Equipment Parameters Related To Energy Use (E.G. Standby Mode) In Order To Optimize Energy Consumption. 7. The Purpose Of This Procedure Is To Obtain Echocardiographs With The Technical, Quality, Operational And Functional Parameters Specified In The Swz, And Not To Purchase Devices From A Specific Manufacturer. For These Reasons, The Contracting Authority Has Exercised Due Diligence To Ensure That The Subject Matter Of The Contract Is Not Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Could Lead To The Preference Or Elimination Of Certain Contractors Or Products. If, Despite This, It Turns Out That There Are Such Indications Anywhere In The Swz, They Should Not Be Treated As Requirements Relating To The Subject Of The Contract, And Should Be Considered Only As Informational Indications (Not Binding On Contractors). For These Reasons, An Offer That Does Not Meet Such Indications Will Not Be Considered Inconsistent With The Content Of The Swz And Will Not Be Rejected For These Reasons. 8. This Subject Of The Order Constitutes An Expense
