The Subject Of This Order Is The Successive Deliveries Of Reagents For Molecular Biology From Thermo Fisher Or Equivalent, Specified In Terms Of Type And Quantity In The Assortment And Price Form, Constituting Annex No. 2 To The Swz, Subject To Section 2 And Following.2. The Subject Of The Order Specified In Annex No. 2 Was Prepared On The Basis Of An Analysis Of Supplies Of Reagents For Molecular Biology From Thermo Fisher, Made Over The Last 24 Months, Taking Into Account Quantitative Changes Necessary For The Implementation Of Scientific And Research Programs, The Continuation Of Which Requires The Absolute Use Of Reagents From The Same Manufacturer Or The Manufacturer Of Equivalent Reagents Referred To In Section 3.3. Considering The Specificity Of The Subject Of The Order (Reagents For Molecular Biology From Thermo Fisher) And The Resulting Impossibility To Clearly Describe The Equivalence Criteria, Which Cannot Be Described In A Sufficiently Precise Manner, Pursuant To Art. 99 Section 5 And 6 Of The Act, The Contractor Who Refers To Equivalent Products (From A Manufacturer Other Than Thermo Fisher) Specified In The Assortment And Price Form (Appendix No. 2 To The Swz), Is Obliged To Demonstrate, By Submitting The Evidence Referred To In Section 5 Of The Act Along With The Offer, In Accordance With The Provisions Of Chapter Additional Activities (Procedures), The Need To Purchase Additional Reagents Or Other Consumables, Calibration Of Devices (If Applicable), And Also Assume Responsibility For Damage To The Equipment Resulting From The Use Of The Offered And Delivered Equivalent Reagents, Based On The Opinion Issued By The Authorized Service Of The Equipment Manufacturer.4. The Contractor Is Obliged To Implement The Subject Of The Contract In Accordance With The Dnsh Principle (Do No Significant Harm), Included In Regulation (Eu) 2020/852 Of The European Parliament And Of The Council Of 18 June 2020 On Establishing A Framework To Facilitate Sustainable Investments, The So-Called Taxonomy, At Least To The Extent Specified In Chapter Xi Of The Swz.
