Tenders Are Invited For Delivery And Assembly Of The First Furniture For The Municipal Nursery At Ul. Minkiewicza 50 In Suwałki As Part Of The Active Toddler Program (Part 3)
1. The Subject Of The Order Is The Delivery And Assembly Of The First Furniture For The Municipal Nursery At Ul. Minkiewicza 50 In Suwałki As Part Of The Active Toddler Program, In Accordance With The Technical Specifications Of The Furniture. 2. The Scope Of The Order Includes The Delivery, Assembly And Positioning Of Furniture Made Of Stainless Steel, Intended For The Nurserys Kitchen: Washing Room And Catering.3. The Contractor Undertakes To Provide The Ordering Party With Only Brand New, Unused And Unexposed Furniture, Complete, Ready For Use Immediately After Delivery To The Ordering Party, Without The Need To Purchase Additional Elements.4. A Detailed Description Of The Subject Of The Order Is Specified In The Technical Specification Of The Furniture. The Ordering Party Allows A Tolerance Of Dimensions Up To 3%, Provided That They Can Be Placed Indoors.5. The Subject Of The Order Should Have A Warranty, The Necessary Certificates, Approvals And Documents Confirming The Fulfillment Of The Ordering Partys Requirements And Should Meet All The Requirements Provided For In Applicable Regulations For This Type Of Products And Cannot Be The Subject Of Claims By Third Parties.6. Pursuant To Art. 101 Section 4 Of The Act, In The Place Where The Subject Of The Order Is Described Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows Solutions Equivalent To Those Described. Furthermore, All Such References Should Be Deemed To Be Accompanied By The Words Or Equivalent. Indication Of The Equivalence Of The Offered Solution In Accordance With Art. 101 Section 5 Of The Act And On The Principles Specified Therein Rests With The Contractor, In Which Case The Contractor Is Obliged To Prove, By Attaching To The Offer, The Relevant Evidence Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order.7. The Parameters Specified In The Technical Specification For The Furniture Constitute The Minimum Expected Quality Parameters And The Required Standard, They May Be Replaced By Other Equivalent Ones, But The Obligation To Prove Equivalence Rests With The Contractor. The Contractor Is Obliged To Submit Appropriate Documents Describing The Technical And Quality Parameters, Certificates Required By Law And Other Documents Authorizing The Given Products (Furniture) For Use And Making It Possible To Clearly State That They Are Equivalent.8. If Trademarks Are Used In The Documents, It Means That They Are Provided As Examples And Define Only The Minimum Expected Quality Parameters And The Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Documentation.
