Software Maintenance And Repair Services – Purchase Of A Software Subscription Service, For A Period Of 12 Months, For The Registration And Notification System As Well As Project Management, Including Consultations.. 1. The Subject Of The Order Provided By The Contractor To The Agency For Restructuring And Modernization Of Agriculture In Warsaw (Hereinafter Referred To As The Ordering Party) Is A Service Consisting In Obtaining A Certificate And Support Service For The Software Indicated In Annex No. 1 To The Draft Provisions Of The Contract (Hereinafter Referred To As: Ppu), Constituting Annex No. 8 To The Terms Of Reference (Hereinafter Referred To As: Swz), As A Result Of Which The Ordering Party Will Obtain The Right To Use The Software On A Subscription Basis, Or Delivery Of An Equivalent Solution In Accordance With The Specification Set Out In Annex 1 To The Ppu. 2. Contractor, Under The Contract: 2.1. Will Sell And Deliver Software, Including: 2.1.1. Will Provide License Keys For The Software Or Equivalent Solution; 2.1.2. Will Provide The Ordering Party, On The Terms Specified In The Ppu And The General License Conditions Of The Software Producer, With The Right To Use (On A Subscription Basis) The Software, Including Both The Entirety And Its Individual Elements, The Number Of Users Indicated In Appendix 1 To The Ppu, Together With The Right To Use The Software Producers Documentation (E.G. Technical, User, Administrator); 2.1.3. Will Provide The Ordering Party With The Right To Use The Software And Its Documentation In Accordance With Point 2.1.2 On A Subscription Basis, For 12 Months From The Date Of Signing The Acceptance Protocol Without Any Reservations By The Ordering Party, Including Providing The Certificate (License Document) Issued By The Software Producer; 2.1.4. In The Case Of An Equivalent Solution, It Will Carry Out The Implementation On The Hardware And System Platform Indicated By The Ordering Party At The Ordering Partys Location In Accordance With The Terms Of The Agreement, Including Agreeing With The Ordering Party On The Implementation Schedule, Preparing And Delivering The Technical Design, Acceptance Test Plan And Post-Implementation Documentation In Electronic Form; 2.1.5. In The Event Of An Equivalent Solution, It Will Transfer (Migrate) The Data Indicated By The Ordering Party And Contained In The Jira System Used By The Ordering Party Within A Period Not Exceeding 60 Business Days From The Date Of Conclusion Of The Agreement. 2.2. Will Provide The Ordering Party With The Provision Of The Manufacturers Support (Service), By Issuing An Appropriate Document To The Ordering Party (Certificate), Confirming The Right To Access The Manufacturers Support During The Subscription Period And The Support Service, Indicated In Point 2.1.3., In Accordance With The Manufacturers General Terms And Conditions, 2.3. Pursuant To The Ppu, The Contractor Will Provide The Ordering Party With The Software Support Service During The Subscription Period For 12 Months, Starting From The Date Indicated In The Acceptance Protocol (Consistent With The Subscription Validity Date) Confirming The Delivery Of The Certificate, In Accordance With The Terms Of The Ppu; 2.4. The Contractor Will Provide The Ordering Party With 50 (In Words: Fifty) Hours Of Consultation During The Term Of The Agreement, In The Scope Regarding The Software As Part Of The Remuneration Referred To In § 8 Of The
