Task 1: Supplies Of Medicines From Therapeutic Programsthe Subject Of The Order Is The Successive Deliveries By The Contractor Of Medicines From Therapeutic Programs (Hereinafter Referred To Interchangeably As Goods Or Assortment) Of The Type And Quantities Specified In The Price Form Constituting Annex No. 2 To The Swz And In Accordance With The Draft Provisions Of The Agreement Constituting Annex No. 4 To The Swz. Applies To Task No. 11) If There Is No Demand For The Assortment Covered By The Subject Of The Order, The Ordering Party Reserves The Right Not To Order The Part The Assortment Specified In Annex No. 2 To The Swz, Subject To Point 2). The Contractor Is Not Entitled To Any Claims For Damages Or Claims Based On Another Legal Basis, To Which The Contractor Agrees.2) The Ordering Party Guarantees That The Minimum Value Of Deliveries In The Scope Of A Given Task Will Be 75% Of The Maximum Value Of The Contractors Remuneration For This Task Specified In The Price Form Constituting Annex No. 1 To The Contract.3) The Medicines Offered By The Contractor Must Be: • Approved For Trading And Use In Poland Or Must Have A One-Time Authorization From The Ministry Of Health, • Brand New, Without Signs Of Use, Full And Complete, • Meet The Quality Requirements And Properties Specified By The Ordering Party And The Manufacturer, • Packed In Accordance With The Registration Documentation (Original Packaging) And In Accordance With The Regulations In Force In Poland; Each Package Should Be Accompanied By An Information Leaflet In Polish, • Delivered To The Ordering Party In The Manufacturers Original, Intact Packaging, In A Way That Ensures Their Properties Are Preserved During Transport And Storage In Warehouse Conditions (If Applicable), 4) The Prices Of The Offered Medicines Cannot Exceed The Limits Of Their Reimbursement Announced In The Announcements Of The Minister Of Health On The List Of Reimbursed Medicines, Foodstuffs For Particular Nutritional Uses And Medical Devices. - Applies To Items Included In The List Of Reimbursed Drugs.5) In The Event Of Deletion Of A Given Drug From The List Of Reimbursed Drugs Or In The Event Of Cessation Of Its Production, Expiry Of The Marketing Authorization, Suspension Or Withdrawal Of The Drug From The Market, The Contractor Will Be Obliged To Offer The Ordering Party A Drug With The Same International Name (If Any), Dose, Form, Indications, Included In The List Of Reimbursed Drugs, At The Lowest Price Among The Remaining Drugs, Provided That This Price Does Not Exceed The Limit Refund, Subject To § 6 Section 3 Point 5 Of Annex No. 4 To The Swz (In The Scope Of Supplies Of Medicines). -Applies To Items Included In The List Of Reimbursed Drugs.6) In The Event Of Cessation Of Production Of A Given Drug, Expiry Of The Marketing Authorization, Suspension Or Withdrawal Of The Drug From The Market, The Contractor Will Be Obliged To Offer The Ordering Party A Drug With The Same International Name (If Any), Dose, Form,
