Diesel Oil – Successive Deliveries Of Diesel Oil. The Subject Of The Order Is The Successive Deliveries Of Diesel Oil Intended To Power Compression-Ignition Engines Used In City Buses In An Amount Of Not Less Than 3,800,000 Liters (3,800 M3). The Specified Amount Of The Ordering Partys Fuel Demand During The Term Of The Contract May Be Increased By A Maximum Of 15% Without The Need To Conclude An Annex To The Contract. The Indicated Tolerance Regarding The Volume Of Fuel That Is The Subject Of The Order Should Be Understood As An Option Right Within The Meaning Of Art. 441 Pzp. The Ordering Party Reserves The Right To Unilaterally Extend The Order Within The Scope Of The Option Law In An Amount Not Exceeding 15% Of The Demand. The Right Arising From The Option Will Be Exercised Automatically Through The Delivery Of Fuel And Its Subsequent Settlement By The Contractor. All Requirements Included In The Description Of The Subject Of The Order Also Apply To The Execution Of The Order Under The Option Law. The Discount Under The Option Right Does Not Change In Relation To The Discount Specified By The Contractor For The Basic Order. The Option Right Is A Unilateral Right Of The Ordering Party, Which He May, But Is Not Obliged To Use, As Part Of The Implementation Of The Subject Of The Order. If The Ordering Party Fails To Exercise The Option Right, The Contractor Shall Not Be Entitled To Any Claim In This Respect. The Ordering Party Indicates That The Minimum Amount Of Performance Specified In The Contract Is 50% Of The Amount Of M3 Of Diesel Oil Indicated Above.
