Tenders Are Invited For Delivery Of Liquid Fuels For The Municipal Greenery Authority In Elbląg

1. The Subject Of The Contract Is The Successive Delivery Of Liquid Fuels, Hereinafter Referred To As Fuels, For The Ordering Partys Motor Vehicles And Equipment In A Total Amount Of 55,100.00 Liters, Including: 1) Diesel Oil (On) - 40,000.00 Liters; 2) Unleaded Petrol 95 -15,000.00 Liters;3) Unleaded Petrol 98 -100.00 Liters.4) The Subject Of The Contract Indicated In This Section Is Hereinafter Referred To As The Basic Order.2. The Minimum Size Of The Scope Of The Order, Subject To Section 9 And § 9 Section 1 Point 2) Amounts To 45,000.00 Liters3. The Unit Prices And Quantities Of Fuel Given In The Contractors Offer, Including The Discount Offered, Constitute The Basis For Determining The Amount Of The Contractors Remuneration. The Amount Of Fuel Purchased Will Depend On The Current Needs Of The Ordering Party. The Amount Of Fuel Specified In Section 1 Is Only A Specification Of The Quantity Up To Which The Order Will Be Processed.4. The Ordering Party Reserves The Right To Exercise The Right Of Option, I.E. To Purchase Larger Quantities Of Fuels Depending On The Ordering Partys Needs And Financial Resources. The Maximum Total Amount Of Fuel Within The Scope Of The Option Law Is Set At 9,100.00 Liters, Including: 1) Diesel Oil (On) - 5,600.00 Liters; 2) Unleaded 95 Petrol - 3,000.00 Liters; 3) Unleaded 98 Petrol - 500.00 Liters.5. If The Ordering Party Exercises The Option Right, The Contractors Contractual Obligation Is To Perform The Service To The Extent Covered By The Exercised Option Right On Terms And Conditions Such As Those Of The Basic Order. 6. The Condition For The Commencement Of The Exercise Of The Option Right Is The Submission By The Ordering Party Of A Written Declaration Of Will, Under Pain Of Nullity, To Exercise This Right. The Ordering Party Submits The Above-Mentioned Declaration Of Will Before The Funds Or The Total Amount Of Fuels Provided For In The Basic Order Are Exhausted. The Ordering Partys Exercise Of The Option Right Does Not Require The Conclusion Of An Annex To This Agreement. 7. The Ordering Party Reserves That It Is Not Obliged To Use The Entire Amount Of Fuel Indicated In Section 4. The Amount Of Fuel Purchased Under The Option Right Will Result From The Current Needs Of The Ordering Party.8. Failure By The Ordering Party To Perform The Contract In The Scope Of The Option Right Does Not Require Giving Reasons And Does Not Constitute The Basis For Its Liability For Non-Performance Or Improper Performance Of The Contract.9. The Ordering Party Has The Right To Mutual Exchange Of Quantities Within The Framework Specified In Section 1 And 4 Types Of Fuel, Up To The Contract Value.10. Gas Station(S) Contractors Must Meet The Requirements Provided For In The Regulations For Gas Stations In Accordance With The Regulation Of The Minister Of Climate And Environment Of July 24, 2023 On The Technical Conditions To Be Met By Liquid Fuel Bases And Stations, Liquid Gas Bases And Stations, Long-Distance Transmission Pipeline
