B. Chrobrego And Ul. Zielona In Leszno With A Change Of Use For The Purposes Of Cultural Activities. I. Subjective Means Of Evidence: 1. Declaration Referred To In Art. 125 Section 1 Of The Public Procurement Act: 1) The Contractor Is Obliged To Attach To The Offer A Declaration Of Not Being Subject To Exclusion And Meeting The Conditions For Participation In The Proceedings To The Extent Indicated By The Ordering Party. 2) The Contractor Shall Submit This Declaration On The European Single Procurement Document Form Drawn Up In Accordance With The Standard Form Specified In Commission Implementing Regulation (Eu) 2016/7 Of 5 January 2016 Establishing The Standard Form For The European Single Procurement Document, Hereinafter Referred To As The Single Document Or Sed. 3) The Declaration Referred To Above Constitutes Evidence Confirming The Lack Of Grounds For Exclusion And The Fulfillment Of The Conditions For Participation In The Proceedings, As At The Date Of Submission Of Offers, Temporarily Replacing The Subjective Means Of Evidence Required By The Ordering Party, Indicated In Section 2 Below. 4) If The Contractor Relies On The Capabilities Or Situation Of Entities Providing Resources, Together With The Declaration Referred To In This Section, Also A Statement Of The Entity Providing Resources, Confirming The Lack Of Grounds For Exclusion Of This Entity And, Accordingly, Meeting The Conditions For Participation In The Proceedings, To The Extent To Which The Contractor Relies On Its Resources. 5) In The Event Of A Joint Application For An Order By Contractors, The Declaration (Single Document) Referred To Above Is Submitted By Each Of The Contractors. The Declaration (Jedz) Is Intended To Confirm The Lack Of Grounds For Exclusion And The Fulfillment Of The Conditions For Participation In The Proceedings, To The Extent That Each Contractor Demonstrates The Fulfillment Of The Conditions For Participation In The Proceedings. Attention! The Rules For Preparing And Submitting The Single European Procurement Document (Spd) Are Described In Chapter 8 Of The Swz. 6) The Contractor Is Obliged To Attach The Contractors Declaration To The Offer, Submitted Pursuant To Art. 125 Section 1 Of The Public Procurement Law, Regarding The Grounds For Exclusion Under Art. 5K Of Regulation 833/214 And Art. 7 Section 1 Of The Act On Special Solutions For Counteracting Support For Aggression Against Ukraine And For The Protection Of National Security - A Template Of The Declaration Is Attached As Annex No. 6 To The Swz. The Declaration Referred To In This Point, In The Case Of Joint Competition For The Order, Is Submitted By Each Of The Contractors. This Declaration Is Intended To Confirm That There Are No Grounds For Exclusion In Respect Of Each Of The Contractors Jointly Applying For The Contract. If The Contractor Relies On The Capabilities Or Situation Of Entities Providing Resources, The Contractor Is Obliged To Attach To The Offer Such A Declaration Made By The Entity Providing Resources - A Template Of The Declaration Is Attached As Annex No. 8 To The Swz. 2. Subjective Means Of Evidence Pursuant To Art. 126 Section 1 Of The Public Procurement Act, The Ordering Party Will Call On The Contractor Whose Offer Was Rated The Highest To Submit Subjective Evidentiary Measures Within A Specified Period, Not Less Than 10 Days From The Date Of The Request.
