1. The Public Procurement Concerns: Delivery Of Beef, Pork, Poultry And Pork And Poultry Meats Of The 1St, 2Nd And 3Rd Grade For The Pod Brzozami Social Welfare Home In Warsaw At Ul. Bohaterów 46/48, Hereinafter Also Referred To As The Ordering Party Or The Recipient. 2. The Detailed Scope Of The Subject Of The Contract Is Presented In The Annex To This Description Of The Subject Of The Contract In A Separate Sheet. A Contractor May Submit Only One Offer. 3. The Ordering Party Has Determined The Expected, Estimated Demand For Products/Goods During The Period Of Execution Of The Order, Which Is Not Binding On The Ordering Party And Is Only The Basis For The Contractors To Prepare An Offer. The Contractor Will Not Be Entitled To Any Claims For Compensation In Relation To The Unused Quantity Of The Subject Of The Order. The Ordering Party Ensures The Execution Of The Order Up To 70% Of The Maximum Gross Remuneration Referred To In § 9 Section 2 Of The Draft Contract. 4. The Ordering Party Provides For The Possibility Of Changing The Product/Goods Indicated In The Contractors Offer To A Product/Goods Of The Same Or Higher Quality If, Due To Circumstances Beyond The Contractors Control, The Offered Product/Goods Will Not Be Available On The General Market At The Time Of Execution Of The Subject Of The Order, Which Could Not Have Been Foreseen At The Stage Of Order Execution, While Maintaining Due Diligence.5. The Products/Goods Will Come From Current Production, Will Be Manufactured In Accordance With The Principles Of Gmp (Good Manufacturing Practice), Must Be Admitted To Trading And Sale In Accordance With Applicable Regulations, In Particular: A) The Act Of August 25, 2006 On Food And Nutrition Safety (Journal Of Laws Of 2023, Item 1448), B) The Act Of December 21, 2000 On The Commercial Quality Of Articles Agri-Food (Journal Of Laws Of 2023, Item 1980) Along With Implementing Acts.6. The Products/Goods Constituting The Subject Of The Order Should Be Free From Quality Defects And Have A Shelf Life Of Not Less Than 1/3 Of The Period Specified By The Manufacturer. 9. The Contractor Guarantees The Quality Of The Products/Goods In Accordance With The Standards And Undertakes To Provide A Quality Guarantee For The Delivered Articles. 10. The Products/Goods Delivered Will Be A Means Of Transport That Meets The Requirements Of Applicable Legal Provisions In This Regard. 11. The Deadline For A Single Delivery Will Be In Accordance With The Order Sent By The Ordering Party With A List Of Products/Goods Along With The Date And Time Of Delivery Electronically To The Contractors E-Mail Address, At Least One Day In Advance, By 12.00. 12. The Subject Of The Order Will Be Delivered To The Recipients Office, By The Contractors Transport At The Contractors Expense And Risk, On The Dates Specified In The Order, With The Delivery Taking Place On Mondays And Thursdays Until 11:00 A.M.
