1. The Subject Of The Order Is The Supply Of Fire And Flood Protection Equipment For The Implementation Of Tasks Resulting From The Civil Protection And Civil Defense Program. The Scope Of The Order Includes The Delivery Of The Following Equipment: A) Floating Pumps For Contaminated Water - 3 Pcs., B) 3% Foam Concentrate - 3,400 L, C) 1% Foam Concentrate - 180 L, D) Special Leather Footwear - 100 Pcs., Detailed A Description Of The Subject Of The Order Is Presented In The Attached Documentation.2. The Subject Of The Order Must Meet The Requirements And Be Consistent With: 1) Polish Standards Transposing European Harmonized Standards, Occupational Health And Safety And Fire Protection Regulations, 2) The Ce Declaration Of Conformity (Conformité Europénne), 3) Provisions Included In The Swz And The Draft Contract, Which Constitutes Annex No. 3 To The Swz, 3. The Types Of Equipment And Devices Specified In The Description Of The Subject Of The Order Are Provided To Determine The Technical Standard. The Contractor Has The Right To Replace Them With Equipment And Devices With At Least Equivalent Technical Parameters, Provided That The Assumed Technical Standards Are Achieved. In Each Case Of Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Contractor Should Assume That Such A Reference Is Accompanied By The Words Or Equivalent. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Solutions Proposed By Him Meet The Requirements Specified By The Ordering Party To An Equivalent Extent.4. The Quality Guarantee For The Delivered Subject Of The Order Will Be Assessed By The Ordering Party As One Of The Criteria For Evaluating The Offers. The Ordering Party Requires That During The Guarantee And Warranty Period, All Repairs Or Replacements Covered By The Guarantee Or Warranty Be Made As Part Of The Contractual Remuneration. The Ordering Party Will Not Bear Any Costs Related To Repairs Or Replacement. Minimum Required Warranty Period - 2 Years (24 Months).5. In The Event Of A Complaint About The Poor Quality Of The Delivered Goods Or The Non-Compliance Of The Goods With The Requirements Specified In The Swz, The Ordering Party Requests, Under The Warranty, The Replacement Of The Goods With A New One - Corresponding To The Parameters Described In The Swz.6. In The Event Of Late Delivery Or Lack Of Deliveries Due To The Fault Of The Contractor Or The Contractors Failure To Comply With The Provisions Of Point 7, The Ordering Party Will Order The Goods From Another Supplier And Charge The Costs To The Contractor.7. Reasons For Not Dividing The Contract Into Parts: The Ordering Party Decided Not To Divide The Procedure In Question Into Parts Because It Covers The Same Scope (Except For Flood Sleeves) That Was The Subject Of The Invalidated Part 3 Of The Proc
