1. Providing A 24-Hour Emergency Service In The Housing Stock Owned By Nieruchomości – Brzeziny Sp. Z O. O. In Piekary Śląskie For 20262. The Subject Of The Order Includes The Provision Of A 24-Hour Emergency Service: 1) In Real Estate Whose Address List Is Included In Annex No. 1A To The Swz; 2) To The Extent Borne By The Ordering Party In Accordance With Applicable Law, I.E. The Act Of June 21, 2001 On The Protection Of Tenants Rights And Municipal Housing Resources And Amending The Civil Code (Consolidated Text: Journal Of Laws Of 2023, Item 725) And The Act Of April 23, 1964, Civil Code (Consolidated Text: Journal Of Laws Of 2025, Items 1071, 1172, 1508). 2.1. The Number Of Residential And Multi-Unit Buildings Covered By The Emergency Service Is: 41.2.2. The Ordering Party Reserves The Right To Reduce The Scope Of The Subject Of The Order In The Event Of A Change In The Number Of Buildings Specified In Annex 1A To The Swz, For Reasons Beyond The Control Of The Ordering Party, Resulting In Particular From The Transfer Of The Real Estate Covered By The Subject Of The Order To Another Entity For Management Or From The Demolition Of The Building, Etc.3. A Detailed Description Of The Subject Of The Order And Its Scope Along With Technical And Organizational Conditions Are Included In The Annexes: 1) Annex No. 4 To The Swz - Draft Contractual Provisions (Ppu), 2) Annex No. 5 To The Swz - Description Of The Subject Of The Order (Opz) 3) Annex No. 6 To The Swz - List Of Repaired Failures 4. The Ordering Party Requires That Persons Directly Involved In The Execution Of The Order, I.E. Persons Associated With The Provision Of Maintenance Services Technical And Emergency Services Were Employed On The Basis Of An Employment Relationship Within The Meaning Of Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2025, Items 277, 807, 1423) By The Contractor Or Subcontractor. The Ordering Party Does Not Require The Employment Of Persons Related To The Coordination Of The Provision Of Services On The Basis Of An Employment Relationship. The Requirement Does Not Apply To, Among Others: Natural Persons Running A Business, Incumbent Members Of The Contractors Management Or Supervisory Bodies, Partners Of A General Partnership Or Partnership, To The Extent That They Will Personally Perform Services For The Ordering Party Or The Contractor.
