1. The Subject Of The Order Is The Supply Of Musical Instruments In Accordance With The Detailed Description Of The Subject Of The Order (Opz) Included In Annex No. 5 To This Swz.2. As Part Of The Subject Of The Order, The Contractor Will Deliver The Instruments And Unload Them And Bring Them To The Place Indicated By The Ordering Party (At The Ordering Partys Registered Office). The Instruments Must Be Brand New, In Accordance With The Requirements Specified In The Opz, Free From Any Physical And Legal Defects. Together With The Delivery, The Contractor Will Provide The Ordering Party With All Necessary Documents Regarding The Delivered Instruments (Data Sheets, Approvals And Certificates (If Required), Warranty Cards And Maintenance And Operation Manuals). All Documents Must Be In Polish. 3. The Subject Of The Order Regarding Pianos Also Includes Tuning Of The Instrument After Bringing It In And Setting It In The Place Indicated By The Ordering Party At The Ordering Partys Premises, And Tuning After One Year.4. The Subject Of The Order Was Divided Into 3 Parts In Accordance With Annex No. 5 To The Swz - Description Of The Subject Of The Order. The Parameters Of The Subject Of The Order Presented In Annex No. 5 To The Swz Constitute The Technical And Qualitative Minimum Expected By The Ordering Party. In The Case Of Proper Or Trade Names, It Should Be Understood That Instruments With The Same Or Equivalent Properties And Parameters, But Not Worse Than Those Specified In The Description Of The Subject Of The Order, Are Allowed Due To The Purpose They Are To Serve. The Ordering Party Will Consider The Instruments Offered By The Contractors As Equivalent To The Indicated Musical Instruments If, In Terms Of Artistic Performance, Technical Performance, Functionality And Utility, They Are Equivalent To Those Described In The Subject Of The Order. Equivalent In Terms Of: A) Artistic, Performance And Functional - The Ordering Party Means Instruments Made In Such A Way That, At The Stage Of Their Operation, Will Enable The Achievement Of The Assumed Artistic Values During The Performance Of Musical Works, B) Technical And Functional - The Ordering Party Means Instruments Made In This Way, Which Have A Technically Equivalent Structure And Equipment To The Instrument Included In The Description Of The Subject Of The Order.5. If An Equivalent Instrument Is Proposed, It Must Meet The Requirements Of The Ordering Party In Terms Of Parameters, Quality, Durability And Functionality. It Is The Contractors Responsibility To Demonstrate Equivalence.6. A Detailed Description Of The Subject Of The Order And Delivery Conditions Is Included In Annex No. 5 To The Swz - Description Of The Subject Of The Order And In Annex No. 4 To The Swz - Draft Contract.7. The Ordering Party Allows The Submission Of Partial Offers. Each Contractor May Submit An Offer For One Or More Parts Of The Order. 8.
