1. The Subject Of The Order Includes The Delivery Of A Delivery Vehicle With A Panel Van Body For The Purposes Of Evacuation And Emergency Assistance As Part Of The Task Entitled: Purchase Of A Supply Vehicle.2. The Contractor Guarantees That The Delivered Car And The Equipment Installed In It Are Brand New, Original, Free From Physical And Legal Defects, Complete, Consistent With The Description Of The Subject Of The Order And Will Have A Complete Set Of Required Documents.3. The Contractor Declares That The Delivered Car Is Not Encumbered With The Rights Of Third Parties And Is Not The Subject Of Any Proceedings Or Security.4. Detailed Requirements Regarding The Subject Of The Order Are Specified In The Description Of The Subject Of The Order Constituting Annex No. 4 To The Swz And The Draft Provisions Of The Contract (Ppu) Constituting Annex No. 3 To The Swz.5. The Ordering Party Has Exercised Due Diligence To Ensure That The Subject Matter Of The Contract Is Not Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Could Lead To Privilege Or Elimination Of Certain Contractors Or Products. If, Despite This, It Turns Out That Such Indications Appear Anywhere In The Swz And In Its Annexes (Order Documents), The Ordering Party, In Accordance With Art. 99 Section 5 Of The Act Allows The Submission Of An Offer Equivalent To Those Indicated In The Description Of The Subject Of The Contract, Provided That They Ensure Technical Parameters Not Worse Than Those Assumed In The Swz.6. Moreover, Wherever In The Description Of The Subject Of The Contract Or Other Procurement Documents, The Ordering Party Referred To The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, And Such References Were Not Accompanied By The Expression Or Equivalent, The Ordering Party, In Accordance With Art. 101 Section 4 Of The Public Procurement Law Allows Solutions Equivalent To Those Described.7. In The Case Of Using Materials, Devices, Products Or Equivalent Solutions, Within The Meaning Of Art. 99 Section 5 Or Art. 101 Section 4 Of The Public Procurement Law, The Contractor Is Obliged To Indicate Them In The Offer And To Submit, Together With The Offer, Technical Sheets Or Other Documents Confirming That The Offered Offer Or Equivalent Solutions Meet The Requirements Of The Ordering Party Specified In The Description Of The Subject Of The Order. If The Contractor Does Not Submit The Above-Mentioned Documents Or The Submitted Documents Will Be Incomplete (Thus Not Confirming The Equivalence Of The Offer In The Scope Described In The Description Of The Subject Of The Order, The Ordering Party Will Not Request Their Submission/Supplementation).8.
