The Subject Of The Order Is The Purchase And Delivery Of Two Self-Propelled Mowers With Accessories And Self-Unloading Baskets For The Needs Of The Municipal Sports And Recreation Center In Elbląg, According To The Detailed Description Of The Subject Of The Order Constituting Annex No. 1 To Swz.2. The Subject Of The Order Should Be Brand New, Free From Defects And Damage, And Free From Any Encumbrances To Third Parties And Should Not Be The Subject Of Any Proceedings Or Security.3. The Ordering Party Requires The Delivery Of 2 Identical Mowers With Accessories.4. The Offered Equipment Must Meet The Requirements Of Applicable Regulations And Standards Regarding Safety Of Use, Environmental Protection And Work Ergonomics. The Ordering Party Requires That The Offered Equipment Have The Ce Marking Confirming Compliance With The Requirements Of European Union Directives.5. Together With The Subject Of The Order, The Contractor Is Obliged To Provide Documentation In Polish, Including: 1) A List Of Authorized Service Stations In Poland With Addresses And Telephone Numbers; 2) A Vehicle Warranty Book; 3) User Manual;4) Terms Of The Warranty;5) Spare Parts Catalog;6) Declaration Of Conformity Confirming Compliance With Eu Standards And Regulations On The Basis Of Which The Manufacturer Marked The Product With The Ce Mark.6. The Vehicles Constituting The Subject Of The Order Must Meet The Technical Conditions For Low-Speed Vehicles To Be Used On Public Roads.7. The Contractor Will Deliver The Subject Of The Order To The Ordering Partys Headquarters At Its Own Expense And Risk, After Prior Arrangement Between The Contractor And The Ordering Party On The Date, Time Of Collection And Place Of Delivery. The Delivery Date Will Be Agreed In Writing Or By E-Mail At Least 2 Business Days Before The Scheduled Delivery Date.8. Under The Warranty, The Contractor Will Be Obliged To Provide Lawn Mower Servicing, In Particular Performing Periodic Servicing, Inspections, Maintenance, Etc. Activities To The Extent Required By The Manufacturer And Necessary To Maintain The Warranty Conditions For The Minimum Period Required By The Ordering Party. 36 - Months Warranty.9. The Ordering Party Requires That The Service Point Be Located At A Distance Of No More Than 40 Km From The Ordering Partys Headquarters.10. After Selecting The Offer, After Signing The Contract, And Before Signing The Final Acceptance Protocol, The Ordering Party Reserves The Right To Inspect The Vehicles By Starting And Test Driving (Lack Of Consent To The Implementation Of The Above-Mentioned Condition Will Result In The Ordering Partys Right Not To Sign The Acceptance Protocol, Due To The Fault Of The Contractor). The Contractor Is Obliged To Refuel The Vehicles With Enough Fuel To Enable The Test Drive Referred To Above.11. The Ordering Party May Refuse To Accept The Final Subject Of The Contract If: 1) It Finds Defects In The Subject Of The Contract, 2) The Subject Of The Contract Does Not Meet The
