4. 1. The Subject Of The Order Is The Collection, Transport And Management Of Municipal Waste From Owners Of Residential Properties Located In The Telatyn Commune In The Period From January 1, 2026. Until December 31, 2026 And In Particular: A) Collecting, Transporting And Managing Municipal Waste From Residential Properties Located In The Telatyn Commune, B) Equipping All Property Owners With Bags At The Contractors Expense, C) Collecting, Transporting And Managing Municipal Waste From The Selective Collection Of Municipal Waste In Telatyn (Pszok), D. The Contractor Is Obliged To Collect And Transport Municipal Waste In A Way That Ensures Achievement Of Appropriate Levels Of Recycling, Preparation For Reuse And Recovery Of Municipal Waste Using Other Methods, In Accordance With The Legal Acts In Force During The Term Of The Contract And In Accordance With The Regulations For Maintaining Cleanliness And Order In The Telatyn Commune, In Force During The Term Of The Contract, E) Exercising Control Over The Proper Operation Of The Municipal Waste Management System During Its Collection From Property Owners. The Expected Amount For Waste Collection Will Be 468.06 Mg, And Covered By The Option Right: An Additional 20% (According To The Principles Set Out In § 1 Section 2 Point F Of Annex No. 1 To The Swz). The Ordering Party Reserves The Right To Exercise The Option Right (In Whole Or In Part) If It Is In The Ordering Partys Interest And Results From An Increased Level Of Waste Generated In Households - After Completing The Basic Scope. Orders. It Is Possible To Exercise The Option Right During The Term Of The Contract. The Ordering Party Will Provide Written Information To The Contractor About The Need To Exercise The Option Right As Part Of The Implementation Of The Contract. The Option Right Is A Unilateral Right Of The Ordering Party, Which He May, But Is Not Obliged To Use, As Part Of The Implementation Of The Subject Of The Order - During The Term Of The Contract. If The Ordering Party Does Not Exercise The Option Right, The Contractor Is Not Entitled To Any Claim In This Respect. If The Ordering Party Exercises The Option Right, The Contractors Contractual Obligation Is To Perform The Service Within The Scope Of The Exercised Option Right. The Ordering Party Has The Right To Exercise The Option Right Multiple Times After Completing The Basic Scope Of The Order - But Until The Maximum Scope Of The Option Right Is Exhausted. Collection Of Waste In Excess Of The Option Law Requires An Amendment To The Contract. Activating The Option Will Not Require Changing The Contract. The Ordering Party Will Inform The Contractor In Writing About The Activation Of The Option In The Form Of A Declaration Of Will. The Ordering Party Will Exercise The Option Right If The Amount Of Waste Transferred By Residents Exceeds The Basic Range.4.2.
