1. The Subject Of The Order Is The Provision Of Funeral Services For The Municipal Family Support Center In Bytom As Part Of The Implementation Of The Communes Own Tasks Of A Mandatory Nature Pursuant To Art. 17 Section 1 Point 15 And Art. 44 Of The Act Of 12 March 2004 On Social Assistance (Uniform Text: Journal Of Laws Of 2025, Item 1214, As Amended). Funeral Services Concern The Burial Of Children And Adults, Including The Homeless, Which Will Be Provided In The Form Of Cremation Or In A Traditional Form.2. A Detailed Description Of The Subject Of The Order Is Included In Annex A To The Specification (Swz).3. The Ordering Party Reserves The Right, While Maintaining Unit Prices, To Change The Forecast Quantity Of Services Provided Which Are The Subject Of The Order, Depending On The Specific Types Of Burials Necessary. The Rules Of Settlement For The Implementation Of The Subject Of The Order Are Included In The Draft Contractual Provisions.4. During The Period Of Execution Of The Subject Of The Order, The Contractor Should Have Civil Liability Insurance In The Field Of Business Activity.5. The General Principles And Method Of Order Execution Are Specified In The Draft Contractual Provisions Constituting Annex No. 5 To The Specification (Swz).6. The Ordering Party Requires The Contractor Or Subcontractor To Employ Under An Employment Relationship (Article 95 Of The Public Procurement Law) All Persons Who Will Perform Administrative And Office Work Related To The Implementation Of The Subject Of The Order. Above The Obligation Does Not Apply To Entrepreneurs Personally Performing Any Of The Above. Works, Collaborators Within The Meaning Of The Act Of 13 October 1998 On The Social Security System, As Well As Incumbent Members Of The Contractors Management Or Supervisory Bodies, Partners Of A General Partnership Or Partnership To The Extent That They Will Personally Perform The Service For The Ordering Party Or The Contractor. The Above Applies Accordingly To Subcontractors. Determining The Method Of Verifying The Employment Of These People, The Employers Rights To Control The Contractors Compliance With The Requirements Related To The Employment Of These People And The Sanctions For Failure To Meet These Requirements Are Specified In The Draft Contractual Provisions.7. The Ordering Party Did Not Divide The Procedure Into Parts. Reasons For Not Dividing The Procedure Into Parts: 1) The Subject Of The Contract Concerns Homogeneous Services That Do Not Require Specific Knowledge, Involvement Of Contractors Of Various Industries And Specializations, I.E. It Is Not Addressed To Several Specialized Sme Sectors, Which Could Constitute The Basis For Considering Dividing The Contract Into Several Parts. Each Contractor Must Have Appropriate Equipment And Provide Services In The Same Way, I.E. Primarily At The Same Unit Price For Each Type Of Burial.
