1. The Subject Of This Order Is The Purchase Of Electricity For The Facilities Indicated In Annex 5 To The Swz, In Accordance With The Provisions Of The Act Of April 10, 1997. Energy Law, Civil Code And Implementing Regulations Issued On Their Basis. Electricity Should Meet Technical Parameters In Accordance With The Provisions Of The Energy Law (Journal Of Laws Of 2024, Item 266, As Amended) And The Implementing Regulations To This Act And Polish Standards. Detailed Information Is Included In Annex No. 5, Which Is An Annex To This Tor And The Draft Provisions Of The Contract.2. The Order Covers The Purchase Of Electricity For The Facilities Listed In Annex No. 5 To The Swz, The Estimated Demand For Electricity In The Period From January 1, 2026 To December 31, 2027. Is 610,694.00 Kwh. The Estimated Energy Consumption Is Indicative Only, Used To Compare Offers And Does Not Constitute An Obligation On The Part Of The Ordering Party To Purchase Energy In The Given Amount. The Contractor Will Not Be Entitled To Any Claim For Failure To Collect The Estimated Amount Of Energy By The Ordering Party, Provided That The Minimum Energy Consumption During The Term Of The Contract Will Be 350,000 Kwh (In Words: Three Hundred And Fifty Kwh). The Ordering Party Reserves The Right To Increase The Amount Of Electricity Ordered3. The Contractor Undertakes To Sell Electricity In Compliance With Applicable Quality Standards In Accordance With The Applicable Provisions Of The Energy Law 4. The Sale Takes Place Via The Distribution Network Belonging To Tauron Dystrybucja S.A. (Osd). The Contractor Must Have A Concluded Contract For The Provision Of Electricity Distribution Services With The Distribution System Operator Operating On The Premises Of The Ordering Party.5. The Selected Contractors Duty Will Be To Represent The Ordering Party Before The Distribution System Operator In Matters Related To Reporting A Change Of Supplier. To Perform The Above-Mentioned The Above-Mentioned Activities, The Contractor Will Receive An Appropriate Power Of Attorney (Appendix No. 7.1 To The Swz)6. The Contractor Is Obliged To Perform The Activities Resulting From The Power Of Attorney, Constituting Annex No. 1 To The Draft Provisions Of The Agreement (Appendix No. 7.1 To The Swz), In Particular, The Ordering Party Obliges The Contractor To Notify The Indicated Distribution System Operator To Implement The Electricity Sales Contract Concluded With The Contractor, Submit Declarations Of Will And Determine On Behalf Of The Ordering Party All Necessary Information In The Scope Of Terminating The Currently Binding Contract For The Sale Of Electricity And The Provision Of Distribution Services (Comprehensive Agreement), And Representing The Ordering Party Before The Competent Authority. Distribution System Operator In Matters Related To Concluding An Agreement For The Provision Of Distribution Services. 7. The Ordering Party Informs That The Process Of Changing The Seller Is Carried Out
