The Contracting Authority Reserves The Right Under Art. 221 Of Law No. 98/2016 To Supplement The Quantity Estimated At The Level Of The Award Documentation By Up To A Maximum Of 50% Of The Maximum Quantity For The Framework Agreement/Subsequent Contract. The Right Of The Contracting Authority To Opt For Supplementing The Quantities Of Services Is Conditioned By The Existence Of The Financial Resources Allocated For This Purpose. This Awarding Procedure Is Initiated Under The Following Suspensive Clause, In The Sense That The Conclusion Of Subsequent Contracts In The Course Of The Framework Agreement Is Conditional On The Allocation Of Budget Credits For This Purpose, The Conclusion Of These Subsequent Contracts Being Carried Out In Compliance With The Provisions Relating To The Employment Of Expenses From The Budgets That Fall Under The Scope Of The Public Finance Legislation. Bidders In This Procedure Understand That The Contracting Authority Cannot Be Held Liable For Any Damage If The Clause Becomes Incidental, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority Has Been Notified Of The Existence Of Such Damage.
