The Subject Of The Order Is The Successive Delivery Of Light Fuel Oil For The Needs Of The City Hall Of Kostrzyn Nad Odrą, To Separate Oil Boiler Rooms Located In Two Buildings, The First Boiler Room At Ul. Graniczna 4, Equipped With A Tank With A Capacity Of 8,000 Liters And A Second Boiler Room At Ul. Graniczna 7 Equipped With A Tank With A Capacity Of 4,500 Liters, According To The Needs Of The Ordering Party, In A Maximum Quantity Of 75,000. Liters.2. Terms Of Delivery: 1. Deliveries Should Be Made Successively, According To The Needs Of The Ordering Party, And Within The Time Specified In A Separate Partial Order Submitted By The Ordering Party.2. The Ordering Party Will Place Orders By Fax, Telephone Or E-Mail Until 2:00 P.M. From Monday To Friday.3. The Contractor Will Make Partial Deliveries No Later Than (In Accordance With The Contractors Offer)……………….. From The Moment The Order Is Placed By The Ordering Party, With The Proviso That If The Ordering Party Places An Order On Friday By 2 P.M., The Order Will Be Completed On Monday. In This Case, The Contractor Is Not In Default In Completing The Delivery. Partial Delivery Will Be Made Each Time Upon Confirmation (Wz. Document), Issued By The Contractor And Confirmed By Authorized Persons Acting On Behalf Of The Contractor And The Ordering Party.4. The Person Authorized To Submit A Demand Is The Person Indicated In § 26 Of The Draft Provisions Of The Contract.5. Delivery Made Contrary To The Order Placed By The Ordering Party Is Considered Not Completed And Does Not Result In Any Obligation To Pay Remuneration On The Part Of The Ordering Party.6. The Ordering Party Reserves The Right To Cancel The Order Up To 25% Of The Quantity Of Ordered Heating Oil, Without Having To Incur Any Contractual Penalties. The Contractor Also Waives Any Claims For Damages In This Respect. In Such A Case, The Contractors Remuneration Will Be Reduced On The Terms Set Out In § 20(2)(A) Of The Draft Provisions Of The Contract.7. Fuel Oil Deliveries Will Be Made Directly To The Boiler Rooms - Fuel Oil Tanks In The Buildings Listed In § 2 Section 1 Of The Draft Provisions Of The Contract.8. Deliveries Will Be Made By Road Tanker Equipped With A Legalized And Sealed Meter Enabling Quantitative Measurement Of Light Fuel Oil.9. If The Contractor Finds That The National Standards, European Standards Or International Standards Used In The Swz And In The Annexes To The Swz May Indicate The Producers Of The Products Or Their Sources Of Origin, The Ordering Party Allows Equivalent Solutions In This Respect. 10. This Means That The Technical Parameters Of The Products Indicated In This Way Determine The Minimum Expectations Required By The Ordering Party As To The Quality Of The Products To Be Used To Perform The Subject Of The Contract.
