The Contractor Undertakes To Deliver The Vehicle: 1) Brand New And Complete, 2) Free From Physical And Legal Defects, Unencumbered By The Rights Of Third Parties, 3) Not Being A Demonstration Vehicle, 4) Manufactured No Earlier Than In 2025, 5) Compliant With The Requirements Set Out In The Specification Of The Terms Of Order Under Which This Contract Is Concluded, As Well As Consistent With The Sellers Offer And The Description Of The Subject Of The Order And The Statements And Documents Submitted By Seller At The Stage Of The Public Procurement Procedure,6) Meeting The Requirements Specified In The Law, Including Those Specified In The Act Of June 20, 1997, Road Traffic Law, The Act Of April 7, 2022 On Medical Devices And The Act Of September 8, 2006 On State Emergency Medical Services, And The Implementing Acts Issued On Their Basis,7) Approved For Trading In The Territory Of The Republic Of Poland,8) Meeting The Requirements Specified In The Relevant European Union Directives And Having The Ce Marking,9) Compliant With The Standard: A) Pn: En 1789 - Medical Vehicles And Their Equipment - Road Ambulances Appropriate For Type B And C Ambulances, Intended For The Needs Of Emergency Medical Teams, B) Pn-En 1865 Standard - Requirements For Stretchers And Other Medical Equipment For Patient Movement, Used In Road Ambulances,10) Having Appropriate Certificates And Admitted To The Market And Use In Health Care Facilities In Accordance With Applicable Legal Regulations,11) Having Positive Overload Tests For Stretcher Attachment Carried Out By An Independent Notified Body,12) Ready To Be Registered And Used For Its Intended Purpose In The Territory Of The Republic Of Poland Without Performing Any Additional Activities (In Particular, Including Retrofitting Or Obtaining Additional Documents),13) Having An Approval Certificate Or An Ec Type-Approval Certificate Of The Completed Vehicle (Base Car With Medical Equipment), Issued In Accordance With Regulation Of The Minister Of Infrastructure Of August 2, 2023 On The Type Approval Of Vehicles.2.
