The Ordering Party Informs That The Order Is Not Divided Into Parts. The Reasons For Not Making The Division Are: The Inability To Effectively Coordinate The Activities Of Various Contractors, Which Will Seriously Jeopardize The Proper Execution Of The Delivery, And Excessive Technical Difficulties. The Lack Of Such A Division Also Regulates Warranty Liability. The Subject Of The Order Is A Multifunctional Boom, As It Is Homogeneous, And For Technological And Production Reasons It Cannot Be Divided Into Parts, As It Is An Integrated Machine That Must Harmonize With The Whole. The Division Would Be Irrational And, Above All, It Would Increase Costs.1. The Subject Of The Order Includes The Purchase, Delivery And Commissioning Of A Brand New Multi-Function Boom - 1 Piece, Mowing Heads - 2 Pieces, Along With Training Of At Least 3 People In The Operation Of The Supplied Equipment.2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 2 To The Swz - Technical Form. 3. The Ordering Party Requires That The Delivered Subject Of The Order Be Brand New, Bearing No Traces Of Use, Complete, Free From Any Physical And Legal Defects, Including Construction, Material, Workmanship And Legal Defects, Ready For Use. 4. As Part Of The Execution Of The Order, The Ordering Party Requires The Contractor To Train At Least 3 Persons Designated By Him In The Operation Of The Subject Of The Order. The Training Should End On The Day Of Receipt Of The Subject Of The Order And Take Place At The Place Indicated By The Ordering Party For A Minimum Of Two Hours. The Completion Of The Training Will Be Confirmed By An Entry In The Acceptance Protocol Of The Subject Of The Order, Including The Names And Surnames Of The Trained Persons And The Training Time5. During Acceptance, The Contractor Is Obliged To Provide The Ordering Party With: 1) An Instruction Manual In Polish (In Printed And Electronic Versions); 2) Product Warranty Cards Along With Information On The Terms Of The Warranty Granted And The Procedure To Be Followed In The Event Of The Need To Initiate The Warranty Procedure Before The Manufacturer, With The Proviso That For Products Without Warranty Cards, The Contractor Shall Provide A Collective Quality Certificate Or Declaration Of Conformity, 3) The Wz Document Specifying The Nomenclature Of The Subject Of The Contract And Their Numbers Factory And Catalog Values And Quantities Delivered To The Ordering Party.
