1.1. The Subject Of The Order Is The Supply Of Electricity To The Water And Sewage Management Service And Production Plant Based In Międzybrodzie Bialski For The Purposes Of Operating The Facilities In An Estimated Amount Of Approximately 700 Mwh. A Detailed List Of Electricity Consumption Points Is Included In Annex No. 5 To Swz.1.2. The Given Amounts Of Mwh According To The Tariffs Specified In Annex 1 (Offer Form) To The Swz Are Estimated Amounts. Determining The Expected Energy Consumption Is Used To Select The Most Advantageous Offer And Does Not Constitute An Obligation On The Part Of The Ordering Party To Purchase Electricity In The Given Amounts. The Ordering Party Reserves The Right To Change The Quantity Without The Need To Change The Terms Of The Contract Or Prepare An Annex To The Contract. Actual Energy Consumption (Less Than Or Greater Than The Energy Consumption Forecast Indicated In Annex 1 To The Swz) Will Depend Solely On The Actual Needs Of The Ordering Party, However, Regardless Of The Amount Of Consumption, The Contractor Is Obliged To Apply The Energy Prices Offered In The Offer In Each Case. The Contractor Agrees To The Above. 1.3. The Energy Supply Will Be Settled Based On Actual Energy Consumption (Metering System Readings) According To Prices And Fee Rates Resulting From The Submitted Offer. 1.4. The Supply Of Electricity Will Be Carried Out On The Basis Of The Sales Contract Referred To In Art. 5 Section 2 Of The Act Of April 10, 1997 - Energy Law (Consolidated Text: Journal Of Laws Of 2024, Item 266, As Amended) - Hereinafter Referred To As The Energy Law Act.1.5. This Order Does Not Cover The Provision Of Electricity Distribution Services. 1.6. The Contractor Will Ensure The Sale Of Electricity In Accordance With The Applicable Quality Standards Of Customer Service Specified In The Implementing Acts Issued On The Basis Of The Energy Law Act. The Condition For Commencement Of Deliveries Is The Successful Completion Of The Seller Change Procedure. 1.7. The Contractor Is Obliged To Perform The Duties Of The Entity Responsible For Commercial Balancing For Electricity Sold Under The Subject Of The Order.1.8. The Contractor Must Have Current Contracts Or A Promise To Conclude A Contract With The Dso Distribution System Operator, I.E. Tauron Dystrybucja S.A. Enabling The Sale Of Electricity Via The Dsos Distribution Network To The Ordering Partys Consumption Points. 1.9. The Selected Contractor Will Prepare, Complete And Send Via The Appropriate Information Exchange Platform (Belonging To The Local Dso) Electricity Sales Notifications For All Electricity Consumption Points (Listed In Annex No. 5 To The Swz) To The Distribution System Operator (Tauron Dystrybucja S.A.) - In Order To Obtain Their Positive Verification As Of January 1, 2026. For This Purpose, The Contractor Will Also Prepare The Appropriate Power Of Attorney(S) (Within 2 Days From The Ordering Partys Notification Of The Selection Of The Contractors Offer), Whic
