The Subject Of The Order Is The Supply Of Computer Equipment And Software To The Strawczyn Commune Office As Part Of The Cybersafe Local Government Grant Project. A Detailed Description Of The Subject Of The Order Is Attached As Annex No. 7 To The Swz - Description Of The Subject Of The Order. Obligations Of The Contractor. The Subject Of The Order Should Be Delivered Directly To The Registered Office Of The Ordering Party: Strawczyn Commune Office, On Working Days (Monday To Friday) From 8:00 A.M. To 3:00 P.M.: 1) In Quantities And Assortment Consistent With The Description Of The Subject Of The Order, Brought To The Indicated Room. The Contractor Will Deliver The Subject Of The Order With His Own Means Of Transport, At His Own Expense And Risk. The Contractor Is Responsible For Any Damage Occurring During Transport; 2) All Delivered Devices, Tools, Equipment And Software Must Be Brand New, Free From Physical And Legal Defects, Unused, Originally Packed, Come From Current Production And Include All The Requirements Indicated In The Specification Of Order Terms And Annexes To The Full Extent Specified. They Must Come From The Manufacturers Legal Sales Channel And Cannot Be Subject To The Rights Of Third Parties. Refurbished, Demonstrative Or Post-Exhibition Devices, Equipment Or Their Components Are Not Permitted. Furthermore, The Supplied Software Cannot Ever Be Activated On Another Device Before. The Offered License Must Be Fully Consistent With The Licensing Terms Of The Software Manufacturer And Enable Its Full Legal Use. The Ordering Party Reserves The Right To Verify The Legality Of The Software Directly With The Manufacturer If It Has Doubts As To The Legality Of Its Origin;3) All Requirements Regarding The Subject Of The Order Indicated In The Terms Of Reference And Annexes Should Be Treated As Minimal;4) The Contractor Will Ensure That The Delivered Devices, Tools, Equipment And Software Will Meet The Requirements Resulting From Applicable Legal Provisions, In Particular In The Scope Of Required Certificates, Technical Opinions And Approval For Use In Poland, If Required;5) The Contractor Should Have Appropriate Means And Conditions Technical, Economic And Organizational Potential Necessary To Complete The Order; 6) The Return Of Goods That Are Unsuitable For Use And The Delivery Of Replacement Goods, Free From Defects And Defects, Will Be Made At The Expense Of The Contractor.
