1. Subject Of The Order: Purchase And Delivery Of Food Products For The School Canteen At Primary School No. 3. Zbigniew Herbert In Wronki On School Days From January 2, 2026. Until December 21, 2026 2. Due To The Inability To Clearly Determine The Subject Of The Order In Terms Of Quantity, The Ordering Party Envisages Using The Option Right. During The Order Execution Period, The Ordering Party Expects To Make A Minimum Level Of Deliveries Related To The Successive Delivery Of Food Products Specified In Point. 8 And In The Material And Price Forms At The Level Of 70% Of The Order Value. Providing For The Right Of Option, The Ordering Party Has The Right To Increase The Order, In Accordance With The Net Unit Prices Of Individual Products Included In The Material And Price Forms. The Ordering Party Will Notify About The Need To Exercise The Option Right By Sending Information To The Contractor Via E-Mail (To The E-Mail Address Indicated In The Agreement) Or Via The Postal Operator To The Correspondence Address Indicated In The Agreement. The Ordering Party Reserves The Right To Exercise The Option Right To An Incomplete Extent, Which Depends On The Needs Of The Ordering Party. Delivery Under The Option Will Be Carried Out On The Same Terms As In The Case Of The Basic Order, Described In Detail In Part Iii Of The Swz - Draft Provisions Of The Contract. If The Ordering Party Does Not Use The Option Right Or Exercises The Option Right To An Incomplete Extent, The Contractor Shall Not Be Entitled To Any Claim Against The Ordering Party In This Respect.3. The Contractor Undertakes To Deliver Goods That Meet The Requirements Specified In Current Legal Regulations, I.E. Admitted To Trading In Poland And Having The Necessary Certificates, Approvals, Hdi, Etc. Documents Provided For By Law, To The Sanitary Records, And Takes Full Responsibility In This Respect. The Contractor Provides These Documents To The Ordering Party With Each Delivery. Detailed Delivery Conditions Are Specified In The Draft Provisions Of The Contract Constituting Part Iii Of Swz4. The Term Type Or Equivalent Product Means Products With No Worse Quality Parameters, Having The Same Organoleptic Properties (Taste, Smell, Color, Consistency) And Containing At Least The Same Raw Materials Used For Production As The Products Specified By The Ordering Party. If The Offer Includes Equivalent Items, It Is Necessary To Attach Documents Confirming Their Parameters. The Contractor Is Obliged To Prove That The Offered Article Is Equivalent To The Articles Specified By The Ordering Party.5. The Capacity And Weight Of The Packaging Cannot Differ From The Capacity And Weight Suggested By The Ordering Party. During The Execution Of The Order, The Ordering Party Allows For The Possibility Of Changing The Capacity And Weight Of Food Products In The Event Of Withdrawal Of A Given Product With The Given Weight From The Market And In The Event Of Its Difficult Availability In Trade.
