The Subject Of The Order Includes The Collection, Transport And Processing Of Stabilized Municipal Sewage Sludge, Sand From Sieve Sand Traps And Screenings Produced At The Ożarowice Wastewater Treatment Plant In The Scope Of: • Placing A Container At The Place Of Storage Of Stabilized Municipal Sewage Sludge, Sand And Screenings At The Sewage Treatment Plant In Ożarowice At Ul. Tarnogórska 67, • Collection, Transport To The Place Of Business Along With Processing, • Handing Over The Waste Covered By The Order To The Contractor By The Ordering Party Will Result In The Transfer Of Responsibility For The Waste To The Contractor, • The Ordering Party Does Not Allow The Recovery Of Municipal Sewage Sludge Through Its Use Within The Meaning Of Art. 96 Of The Waste Act.2. The Ordering Party In Connection With Art. 441 Section 1 Of The Public Procurement Law Provides For The Right Of Option. A Detailed Description Of The Options Can Be Found In The Draft Contractual Provisions.3. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To Swz.4. The Ordering Party Requires The Contractor To Complete The Order In Accordance With The Description Of The Subject Of The Order (Appendix No. 1 To The Swz) And Under The Conditions Specified In The Draft Provisions Of The Contract (Appendix No. 2 To The Swz).5. The Ordering Party Did Not Divide The Order Into Parts. Justification For The Lack Of Division Into Parts. Division Of The Subject Of The Order - Collection And Transport Of Stabilized Municipal Sewage Sludge, Sand From Sieve Sand Traps And Screenings Constitute One Functional Whole Used To Achieve The Required Result, Therefore The Subject Of The Order Cannot Be Divided Into Parts. The Lack Of Division Of The Order Into Parts Is Dictated By Technical And Organizational Reasons. The Ordering Party Did Not Divide The Contract Into Parts Taking Into Account Technical Considerations And The Specific Nature Of The Contract. Carrying Out Separate Procedures For The Collection Of Specific Types Of Waste Does Not Guarantee A Reduction In The Total Costs Of The Above Procedures, Because A Potential Contractor, By Concluding A Comprehensive Agreement With Entities Dealing With Waste Collection And Management, Has A Greater Opportunity To Negotiate A More Favorable Price Than The Ordering Party Individually. Moreover, It Should Be Emphasized That The Ordering Party Does Not Have Its Own Waste Processing And Management Installation To Which It Could Entrust Their Management. The Division Would Pose The Risk Of Excessive Technical Difficulties And Incurring Higher Costs To Perform The Entire Contract Or The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Contract. Therefore, It Is Reasonable For A Potential Contractor To Collect Individual Types Of Waste Under One Contract. Moreover, The Lack Of Dividing The Contract Into Parts While Conducting The Procedure In One Of The Competitive Modes Provided
