The Contractor Will Perform The Order Taking Into Account The Provisions Of The Swz, Annex No. 1 To The Swz And The Agreement Constituting Annex No. 9 To The Swz.7. The Delivered Equipment Must Be Brand New, Unused, Unrefurbished, Complete, Manufactured No Earlier Than 9 Months Before Delivery, Free From Any Physical And Legal Defects, Technically Functional, And Come From An Official Distribution Channel. The Statement Brand New Means Equipment In Its Original Packaging (The Packaging Must Be Intact And Protected By The Manufacturer). Physical Defect Also Means Any Non-Compliance With The Detailed Description Of The Subject Of The Order. The Equipment Must Be Equipped With All Standard Software Solutions Necessary For Its Operation And Providing The Required Functionalities Of The Equipment, Along With The Right For The Ordering Party To Use These Solutions In Such A Function Indefinitely, But In Each Case Not Less Than For The Time During Which It Will Be Technically Possible To Use The Equipment.
