Description Of The Subject Of The Order The Subject Of The Order Is The Supply Of Spare Parts For Kia And Hyundai Vehicles For The Transport Department Of The Provincial Police Headquarters In Gdańsk. The Actual Number Of Orders Placed With The Contractor Will Result From The Actual Needs Of The Ordering Party. The Specified Quantity Of The Spare Parts Assortment Is An Estimate Which May Change During The Execution Of The Agreement, In Accordance With The Actual Needs Of The Ordering Party, But Not More Than Until The Gross Contract Value For A Given Order Is Exhausted. The Contractor Will Not Be Entitled To Any Claims Against The Ordering Party For This Reason. Orders Will Be Performed Successively And In Accordance With The Current Needs Of The Ordering Party, And Failure To Use The Contract Amount Cannot Be The Basis For Claims By The Contractor. The Delivered Spare Parts Will Be: *) Brand New And From The Current Catalog Of The Tire Manufacturer Or Contractor, Of Good Quality, With Properties Normally Accepted In The Market And Resulting From Their Intended Use, And Having The Required Certificates And Approvals, *) In Accordance With Commission Regulation (Eu) No. 461/2010 Of 27 May 2010 On The Application Of Art. 101 Section 3 Of The Treaty On The Functioning Of The European Union To The Category Of Vertical Agreements And Concerted Practices In The Motor Vehicle Sector, *) Marked With International Approval Marks Used In The Approval Of The United Nations Economic Commission For Europe (Unece) - E Or The European Union E, *) Marked With The Characteristics Of The Manufacturer Of The Vehicle For Which A National Vehicle Type-Approval Certificate Has Been Issued, *) Free From Technical And Legal Defects, Approved For Trading And Grade I. *) In Packaging Marked With The Logo - Trademark Of The Vehicle Manufacturer Or Manufacturer E) Deliveries Will Be Made Successively, At The Expense And Risk Of The Contractor, Based On Orders Placed By The Ordering Party By Phone, In Writing Or By E-Mail. All Requirements Specified In The Documents Indicated Above Are Minimum Requirements And Their Fulfillment Is Obligatory.
