The Main Objective Of The Contract Is To Ensure The Services Of Supervision Services / Site Management Of The Execution Of Works For The Execution Of Hydrotechnical Construction Works - Regularization Of The River Aiudel To Aiud, Alba County, According To The Requirements Of The Specifications And The Award Documentation. The Provider Will Have The Role And Attributions Of The Site Manager, According To The Legislation In The Field (Order No. 1496/2011, Law No. 10/1995). The Activities Required To Be Carried Out Within The Contract And The Period Of Its Completion Are Presented In Detail In The Specifications. The Conclusion Of The Contract Is Subject To The Incident Of The Conditions Provided By The Suspensive Clause. -Suspensive Clause: The Public Procurement Contract Award Procedure Is Initiated Under This Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditional On The Allocation Of Budget Credits For This Purpose, The Signing Of The Contract Being Done In Compliance With The Provisions Relating To The Commitment Of Expenses From The Budgets That Fall Under The Legislation On Public Finances. Considering The Provisions Of Law 98/2016 On Public Procurement And H.G. No. 395/2016, With Subsequent Amendments And Additions, The Contracting Authority Specifies That It Will Conclude The Contract With The Bidder Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By Allocating Budget Commitments/Credits For This Purpose. If, Regardless Of The Reasons, The Budget Commitments/Credits Will Not Be Allocated, For A Period Of 6 (Six) Months From The Date Of Approval Of The Procedure Report And/Or From The Date Of Final Resolution Of Any Appeals, The Awarding Procedure Will Be Canceled By Law, Provided That There Is No Other Source Of Funding, In Accordance With The Provisions Of Art. 212 Para. (1) Lit. C) Sentence 2 Of Law 98/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract. Bidders Within This Procedure Understand That The Contracting Authority Cannot Be Held Liable For Any Damage In The Event Of The Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority Has Been Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions/Suspensive Clause, Assuming Full Responsibility In Relation To Any Damages They May Suffer In The Described Situation. The Number Of Days Until Which Clarifications Can Be Requested Before The Deadline For Submitting Offers/Candidates: 20. The Contracting Authority Will Respond Clearly And Completely To All Requests For Clarifications/Additional Information On The 11Th Day Before The Deadline For Submitting Offers.
