Part 1 Szczucin Commune.1. The Contractor Undertaking The Provision Of Services Related To Winter Road Maintenance Assumes The Obligation To: A) Remove Slipperiness, B) Clear Snow From The Road, C) Remove Snow And Ice Pellets From The Road Surface.2. The Following Types Of Action Are Established - Active Action, Passive Action And Suspended Action.3. The Active Action Will Consist In Direct Work Of Equipment And Personnel In The Field, And Will Be Carried Out In The Intervention System, I.E. At The Request Of The Persons Responsible For The Winter Maintenance Of Roads On The Part Of The Ordering Party, Which Will Be Recorded And Confirmed By The Ordering Party Through An Appropriate Entry In The Equipment Work Log Book Kept By Designated Employees Of The Ordering Party.4. Passive Action Is The Readiness Of The Contractor (24 Hours A Day) To Start Active Action During Which The Employers Employees Check The Condition Of Roads And Observe Weather Conditions, Using Information About The Weather Condition And Directions Of Its Change, Among Others. From The Forecast Office Of The Institute Of Meteorology And Water Management (Imgw) In Order To Make A Quick Decision To Start Active Action. During Passive Action, The Contractor Maintains Equipment And Personnel Ready To Take Active Action. During Passive Action, The Ordering Party Decides To Start Active Action At The Time Offered By The Contractor. If The Performer Performs Active Duty On A Given Day, He Will Not Be Paid Remuneration In Accordance With Passive Action.5. The Ordering Party Reserves The Right To Introduce Action Suspended Due To Weather Conditions, During Which Neither Active Nor Passive Action Is Carried Out, Without The Right To Remuneration For The Contractor And Without Consequences Resulting From The Application Of Contractual Penalties. The Contractor Will Be Notified By The Ordering Party Electronically To The E-Mail Address Indicated In The Offer About The Date Of Introduction Of The Suspended Action. The Ordering Party Has The Right To Resume Winter Road Maintenance At Any Time, Of Which The Contractor Will Be Notified Electronically. In Such A Situation, The Contractor Switches To Passive Action.6. The Operator Of The Equipment Indicated In Point 7 May Be A Car Driver With Appropriate Qualifications, I.E. The Required Category Of Driving License, Knowledge Of The Equipment Used And Training To Work In Winter Road Maintenance. Snow Removal And Snow Removal Techniques Must Not Impede Vehicle Traffic.7. The Service During Active Operation Will Be Performed With The Following Equipment:7.1.
